Judge warns man he's facing long jail term
A Wroxeter man was duly warned
by Judge Garry Hunter to get his
affairs in order before he was
sentenced in January.
Paul Gerald Martin appeared in
Wingham court, Dec. 12 and pled
guilty to a charge of impaired
driving. It is his fifth drunk-driving
related conviction.
Attorney for the Crown Rod
Guthrie said that on April 5 police
were following a truck into Brussels
that was weaving between the yellow
line and the right side of the road. The
driver never exceeded 50 km an hour.
At one point, the accused turned on
floodlights at the rear of the truck
making it difficult for the officers to
see.
Breathalizer readings were 230 mg
of alcohol in 100 ml of blood:
Defence Counsel Mr. Williamson
said that in consideration of his
client's record the judge give him 90
days.
-I wouldn't consider it." said
Hunter.
Williamson said Martin has, since
his arrest, completed a program of
treatment and is working hard to put
the past behind him. His remark that
his client was remorseful brought
skeptism from the judge, however.
"He's remorseful because he got
caught," Hunter stated.
Adding that a six-month sentence
was probable, and Martin should
therefore make arrangements for
someone to look after his business for
him, Hunter concluded; "He can
either start his' time today or come
back in January. But he's not getting
90 days."
A two-year driving prohibition
begins immediately.
Over 80
A Blyth man is spending weekends
in jail after entering a guilty plea to
driving with over 80 mg of alcohol in
his system.
Gordon Groenveld was charged
April 26 after police noted his erratic
driving. His breathalizer readings
were 190 mg el' alcohol in 100 ml of
blood.
The • 41-year-old has a prior
impaired driving conviction.
He was sentenced to 14 days
intermittent and was given 12 months
probation, which is to include
counselling.
Hunter issued the mandatory 12-
month driving prohibition, but added,
"I'm sure the province will keep your
licence for three years."
Drunk driving
A Guelph man was charged with
over 80 and having no insurance,
Oct. 27.
Jason Page pled guilty to both
charctes.
Guthrie said police were
dispatched to a single vehicle crash at
1:30 a.m. which occured, the driver
said. when he lost control while
trying to change a CD.
Seeing signs of impairment he was
taken for a breathalizer test, the
readings of which were 150 mg of
alcohol in 100 ml of blood.
During the investigation it was also
learned that Page had no insurance.
The 21-year-old had apparently
dropped the insurance because he
was trying to pay off $3.500 from a
previous fine.
Hunter fined him $5,000 for no
insurance and $750 on the over 80.
He was given one year to pay. He is
also off the road for a year.
Impaired
A man arrested Aug. 31 for
impaired driving and a charge of
resisting arrest, pled guilty.
Guthrie said police were called to a
light at 4:35 a.m. that day and upon
arriving saw the accused pulling out
of a driveway. Trevor Huffman then
pulled back in and turned out the
lights.
Guthrie said police had dealt with
Huffman earlier in the evening and
concluded then he was intoxicated.
While being arrested, the accused
resisted.
Defence Counsel Glen Carey said
the 23-year-old sustained injuries in
the incident. "His flailing about was
responded to by the officers. He only
has himself to blame."
Carey added that counselling
would be of assistance to his client.
Hunter gave him 12 months
probation with a condition of
counselling. He was fined $750 for
the drunk driving and $250 for the
resist charge. He is also off the road
for a year.
Huffman has six months to pay the
fine.
Stolen property
Mervyn Sean Anderson of
Wingham was charged December of
last year for possession of stolen
property. According to Guthrie, the
victim had returned home from
Christmas shopping and left the
packages in the van in the garage.
They were later stolen.
Almost the same day, the accused
returned a Sony Playstation to the
place of purchase for a refund. The
victim was out $149, while the store
lost the sale.
Defence Counsel Lynn Johnston
said her client did not steal the items,
but turned a blind eye when the thief
asked him to return it.
Johnston asked that Anderson get
the same punishment as the
accomplice, who received a
suspended sentence.
He also was ordered to make
restitution within 60 days and will
serve 12 months probation.
Utter death threat
A Fordwich man pled guilty to
uttering a death threat.
Guthrie said that on Nov. '13
Hendrikus Vandenbrink called police
saying he wanted a person removed
from his home: They had both been
drunk and were arguing./
When police arrived they found the
accused in a parking lot. The victim,
who also resided at the liouse, told
police she wouldn't leave and during
the course of the fight, Vandenbrink
had said that if she didn't he would
kill her. He later repeated the same to
police.
He received a suspended sentence
and was placed on 12 months
probation. He is to have no contact
with the victim and must receive
counselling.
There is also 5 five-year weapon
prohibition.
Indecent exposure
A Lucknow man was given a
conditional discharge and 12 months
probation during which he must
receive counselling after pleading
guilty to indecent exposure.
John MacDougall was arrested
Feb. 18. He was sitting naked in a car
on the highway and would get out
when others passed by.
