Court news
Man jailed for marijuana production
A Wingham man is spending
weekends in jail after pleading guilty
to a charge of marijuana production
in Wingham's provincial offences
court, Sept. 19.
Van Russell White was charged
April 11 after police executed a
search warrant at his residence.
Federal Crown Mike Donnelly said
80 plants in various stages of
growth. were found in the basement
along with a high-intensity grow
light and other marijuana production
equipment.
Police also found about 500 gm of
dried plants in a bag in the pantry as
well as a small amount in the house.
Stating it was not a "particularly
sophisticated" operation, Donnelly
offered a joint submission for 90
days to be served intermittently.
Defence counsel noted her client's
early plea and his co-operation with
the investigation.
In addition to the sentence, Judge
Garry Hunter also placed White on
12 months probation. There is also a
10-year weapon prohibition.
Drunk driving
A Lucknow man pled guilty to
driving with over 80 mg of alcohol
in 100 ml of blood.
Lawyer for the Crown Paul Ross
said that Robert MacMillan was
travelling in North Huron on July 23
when a police officer on patrol saw
the accused throw a beer bottle from
the window of his vehicle.
The officer, after stopping
MacMillan, found four full bottles of
beer behind the driver and three
empties under the seat. The accused
admitted consuming two beers.
Breathalizer readings were 272 mg
of alcohol in 100 ml of blood and
251 mg.
MacMillan was fined $1,000 and
is off the road for a year. He was
given 12 months to pay.
Own firearms
Theodore Thompson of Wroxeter
was lined $300 for failing to comply
with an order that he not possess any
firearms or licenses and $300 for
possessing firearms where he was
not entitled to possess them.
Thompson pled guilty to both
counts.
Ross said that on March 20 the
accused had been released on his
own undertaking with regards to an
incident involved an aKeged threat
with the use of firearms. Any he
owned were to be turned over to the
police.
It was discovered that Thompson
owned a Smith and Wesson .22
calibre handgun and Ruger .22 rifle
which he had not turned over, nor
did he turn over licences for the
guns.
An officer contacted him twice
with regards to this, Ross said.
Defence counsel, Mr. Ferguson,
explained that at the time of
Thompson's arrest he advised the
officer that there was an application
for a licence in process. The other
guns were stored in another
residence.
Thompson was given six months
to pay the fine.
Mischief
The judge was less than amused
when he heard the information
regarding Martin Sturzenegger's
guilty plea.
The Auburn-area youth had been
with a group travelling in a vehicle
on Marnoch Line in North Huron on
June 15, when the accused got out
and demolished a mailbox. Damage
was estimated at $20-$40.
"That must have been hysterical,"
said Hunter.
Sturzenegger was given a
conditional discharge and placed on
12 months probation. He must also
make restitution in the amount of
$40.
Conditional discharge
Kristie Palen of Exeter pled guilty
to causing a disturbance in a public
place by fighting Aug. 10.
She and another woman were
"actively fighting" in front of a bar
in Wingham when officers saw
them. When police tried to break it
up the girls "resisted", said Ross.
Palen has no record. She was
placed on 12 months probation with
a conditional discharge. She is to
have no contact with the other
person involved.
Suspended sentence
Hunter suspended passing of
sentence on an assault case.
Carey Joseph Beard of North
Huron pled guilty to a charge
relating to July 24. Ross said Beard
had argued with the victim, grabbed
her and pushed her.
He has no related record.
Beard was placed on probation for
a year and is not to associate with the
victim.
There is also a five-year weapon
prohibition.
Narcotic possession
Jeffrey Camm of Clifford pled
guilty to marijuana possession. On
Sept. 23 after being stopped in a
routine check, Camm was searched
and police found a small bag
containing marijuana in his front
pocket. He was given a conditional
discharge and placed on 12 months
probation.
Absolute discharge
H. David Wolstenholme of
Wingham pled guilty to failing to
comply with an order that he reside
at a specific residence and notify
RCMP of any change.
The accused, who was to be
staying in Bluevale, was arrested
June 25 in Wingham.
Duty Counsel John Schenk
explained that Wolstenholme was
staying with someone at the
residence to support them during an
illness.
Mischief
Kathy E. Burbidge was granted
absolute discharge after
pleading guilty to mischief under
$5,000.
Ross said that officers were called
to an apartment unit on Feb. 22
because a woman had broken a
window. A second call said that there
was "screaming" in the unit.
Burbidge was intoxicated at tie
time.
She told the court that she had
joined Alcoholics Anonymous and
had been sober for six months.
"Good," said Hunter before
granting the discharge.
Peace bond
Ryan McDougall entered into a
12-month peace bond. He is to have
no contact with the complainant.
