Court news Wingham man spending weekends in jail A Wingham man will be spending weekends in jail after pleading guilty in Wingham's provincial court, Jan. 17 to a charge of having care and control of a motor vehicle. Crown Attorney Bob Morris said police were called regarding a per- son slumped over a steering wheel of a car parked in a lot in Morris Twp. The van was running and the lights were on. Morris said that though the officer spoke to the man, Christopher Gauntley, and touched his arm, he didn't respond. When he finally did awake and spoke to the officer his speech was slurred. As he got out of the car he was unsteady on his feet. Morris said Gauntley refused to provide a breath sample at the detachment. Gauntley's record showed a con- viction for impaired operation of a motor vehicle in Oakville on Jan. 6, 1992 and one for driving with over 80 mg of alcohol in 100 ml of blood from Kitchener, Sept.,25, 1996. Counsel for the accused said this series of events began from prob- lems with his business. The 50-year- old was on medication and "in effect had been drinking, but subsequently learned afterwards that under no condition should he have alcohol" with the medication, said the attor- ney. His client, he said, believes that had he taken the breathalizer test 'he would not have blown over. Gauntley joined AA Nov. 12 and has not had a drink since the inci- dent. Judge Garry Hunter sentenced him to 45 days intermittent. He is off the road for two years. Over 80 An RR2, Lucknow man pled guilty to a charge of driving with over 80 mg of alcohol in 100 ml of blood. Donald G. MacKinnon was stopped by police in the Twp. of Ashfield-Colborne-Wawanosh on June 12 because of a burned-out headlight. The officers noticed an odour of alcohol and MacKinnon admitted to having one drink. After failing the roadside test he was taken to the detachment where breathalizer readings showed 140 mg of alcohol in 100 ml of blood. MacKinnon had been convicted in Goderich Jan. 25, 1993 of over 80. Besides the 12-year driving prohi- bition., the 49-year-old was fined $1,000. He was given six months to pay. Impaired Aaron Bromley of Monkton pled guilty to impaired driving. At 1:25 p.m. Nov: 17 police were called to the scene of an accident on Moncrieff Road in Morris- Turnberry. They questioned the pas- senger of the vehicle who identified Bromley as the driver and said he had run away. Found 150 metres away in a field, Bromley showed signs of impair- ment and officers detected an odour of alcohol. He was arrested for leav- ing the scene of an accident and impaired. Breathalizer readings were 160. He has no similar record. Duty Counsel John Schenk sub- mitted a letter from Perth Addiction Services showing "the young man is trying to deal with this problem, and is prepared to take responsibility for what he's done." He was fined $850 and is off the road for a year. Bromley has nine months to pay the fine. Cruelty to animals Judge Hunter suspended passing of sentence on a London man who failed to provide adequate food and shelter for goats and ducks he housed on a Turnberry property. Having pled guilty Ken Leneve, 56, was placed on three years proba- tion and ordered to make restitution in the amount of $871 to cover the cost of the removal of the animals by the Ontario Society for the Prevention of Cruelty to Animals (OSPCA). Morris said the Leneve property had a bushlot, housetrailer and lean- to where he housed some goats and ducks. A neighbour reported in early March that the animals were roam- ing freely. • Officers arrived and found one dead duck and one dead goat. The shelter had fallen down and was not adequate for protection from the cold. There was no food. Contacting the .OSPCA, police were told that that organization had received a similar complaint and that Leneve had promised to repair the shelter and attend every other day to see that things were alright. A subsequent visit by police fol- lowed. Four more goats had died as well as one duck. By March 28 the number of dead goats was eight. Counsel for the accused Tom White, said Leneve currently has no animals nor is he intending to own any. He thought a neighbour was tending the goats and ducks, but there had been a breakdown in com- munication. "He did have warnings, but thought the neighbour would still feed them, so didn't take .the appro- priate steps and the animals suffered and died," said White. Assault A Teeswater woman pled guilty to two counts of assault. Morris said Renae Fischer had been separated from the first victim. for 14 months. She was eight months pregnant at the time. On July 22 she left a note containing profanities about money he owed her. She showed up later at his home and after exchanging words, she struck him several times. Seeing that he had a female guest, Morris said, Fischer then attacked the woman, before punching the man in the nose. She has a record for assault in Kitchener from 1994 and one from Walkerton in 1990 for assault caus- ing bodily harm. Defense Counsel Mike Donnelly said the accused and male victim have two children who reside with Fischer. Access is gained through a third party. Also, Fischer has begun coun- selling sessions. Hunter fined her $250 on each charge and placed her on probation for 12 months. She is to have no con- tact with either victim other than with the male for access arrange- ments. She is to continue counselling and is also prohibited from owning weapons for a period of five years. Fischer has three months to pay the fine. Possession An RR3, Goderich man pled guilty to marijuana possession. Scott B. Cook was stopped by police while driving in Morris Twp., Dec. 6, for having no taillights. As he looked in the glove compartment for his registration and insurance and officers noticed a small bag with rolling papers and scissors. Cook was fined $100, He was given three months to pay. Peace bonds Two men entered into peace bonds in unrelated cases. Brian Egginton and Joe Terpstra must be on good behaviour and keep the peace for a period of 12 months. They are also to have no contact with the victims in each case.
