Judge sentences Morris Twp. man to 90 days for cultivation
A Morris Twp. man is spending
weekends in jail for awhile after
pleading guilty in Wingham's
provincial court, Sept. 17, to mari-
juana cultivation.
Federal Crown Mike Donnelly
said that OPP Const. Scott had
received information in March of
marijuana being grown in the base-
ment of a Morris Twp. home. The
residence of Mark Dicastri was
searched March 26.
Donnelly said when police
entered they could smell freshly
growing marijuana. In the grow
room they found 77 plants and
indoor growing equipment.
Defense asked Judge Hunter to
take into account that the 28-year-
old had entered a guilty plea and
that the narcotic was not being
grown for anything other than per-
sonal use. His client, though having
developed a large habit, has since
the arrest quit using marijuana.
Judge Hunter sentenced him to
90 days in jail.
OVER 80
A Teeswater man pled guilty to a
charge of over 80.
Assistant Crown Mary Mahas
said that at 3:50 a.m. on June 21,
OPP officers stopped a car in
Howich which radar had clocked at
110 km in an 80 km zone.
Police noticed an odour of alco-
hol on the driver, Brian Hodgins, as
well as visible signs of impairment.
Breathalizer readings were 140
and 130.
In addition to the 12-month driv-
ing prohibition, Hodgins WaS fined

POSSESSION
Scott Clarkson of Brussels was
fined $100 for possession of mari-
juana.
According to Donnelly, the 18-
year-old was stopped by police in
Brussels June 27 for a liquor
license offense. They found 2.5 gm
of marijuana in a plastic bag on the
accused.
He was given 60 days to pay.
SENTENCED
A Wingham man who pled guilt
in July to a charge of driving while
disqualified was sentenced to 45
days in jail to be served intermit-
tently.
Rod Adams was charged April
10 following an accident in Morris
Twp.
CARE AND CONTROL
Greg Montgomery of Culross
Twp. pled guilty to a charge of care
and control.
Mahas said that on Aug. 19 OPP
had received a complaint from
some East Wawanosh residents of a
speeding car. Police found the vehi-
cle in a ditch just west of Wingham
on County Rd. 86.
The driver, Montgomery, was
taken to the station for a breathaliz-
er test. Readings were 218 and 220.
Defense council Tom White
noted that his client had pled guilty
at his first appearance.
He was fined $750 in addition to
a 12-month driving prohibition.
ASSAULT
A Wingham man who pled guilty
to an assault charge was given a
suspended sentence and placed on
probation for one year.
Richard Baxter, according to
Mahas, was on his way home after
a party on March 29 with the inten-
tion of seeing his girlfriend. Mahas
said the girlfriend was concerned
about her safety and friends were
trying to keep her away from the
accused.
As one of them tried to talk to
him he struck her.
Defense Alan Mill said that Bax-
ter was now taking counselling.
Hunter ordered him to continue
with this during his period of pro-
bation.
ASSAULT
A Lucknow man pled guilty to a

On Sept. 11 at approximately
2:15 a.m. an alarm was activated at
the Belgrave Co-op. Officers
responded to the alarm and arrived
within five minutes.
According to police, entry into
the building was found through the
rear window of the business.
Nothing was taken and the culprits
fled the property after the alarm
went off.
A search followed but no
suspects were found.

of an incident May 22 in East
Wawanosh.
According to Mahas, Michael
Johnston had forced his way into
the home of his ex-girlfriend and
lunged at her new boyfriend. He
shoved the victim, head-butted him
and kicked him in the face, said
Mahas. The victim sustained some
swelling cuts and bruises, she
added.
Mr. Brock, defense counsel,
explained that the relationship had
been more than boyfriend-girl-
friend and that Johnston and the
woman had been common-law
spouses. They have a child together
and, he said, Johnston was having

BRUSSELS
On Sept. 11 at approximately
7:30 a.m. a break-in was
discovered at G & M Auto Parts on
Turnberry St. in Brussels.
Police said that through the night
someone attempted to enter the
building through a wall. A hole was
cut into the steel siding on the east
side of the building roughly 3' x 2',
then peeled back. A 10-inch hole
was cut into the drywall directly
behind this.
Entry was not gained due to other
difficulty dealing with the separa-
tion.
He is now "getting things under
control" Brock stated.
Hunter suspended sentence and
placed Johnston on probation. He is
to have no contact with the victim
and must take counseling as direct-
ed by the probation officer. There
is also a five-year weapon prohibi-
tion.
SENTENCING
An RR I, Ethel man was sen-
tenced to 90 days for drunk driving.
Steven Gilkinson appeared in
court for the first time on June 18,
but sentencing was delayed until
the September court.

BLYTH
On Sept. 12, 1998 at
approximately 8 a.m. the owner of
a white 1989 Pontiac 6000, four
door was found damaged.
Police said the vehicle driver's
side door was found dented high up
above the molding. This occurred
sometime between 2 a.m. and 8
a.m. in a private driveway on
Dinsley St., Blyth.
