Charged with assault, man gets jail time
A West Wawanosh man is spend-
ing a few days in jail after appear-
ing in Wingham's provincial court,
July 16.
Graham Cere, RR2, Lucknow
was charged with assault causing
bodily harm and with breaching
probation, as a result of an incident
in Wingham, March 25. He pled
guilty to a lesser charge of common
assault and to the breach charge.
According to Attorney for the
Crown Norman Pickell, police
were called to the hospital. The vic-
tim said he had been assaulted by
Cere, who had head bunted him
and punched him around the head
and face. Pickell said there was
some swelling as a result but noth-
ing major.
It was discovered that Cere was
on probation at the time.
Defense Counsel Mike Donnelly
said that Cere had responded to a
motion the victim had made
towards him.
He asked Judge Garry Hunter, if
considering a period of incarcera-
tion to make it brief enough so his
client could be released in time to
begin classes at college in the fall.
Cere received 30 days for the
assault and 15 days consecutive on
the breach. He was also placed on
12 months probation, during which
time he is to have no contact with
the victim.
There was also a five-year
weapons prohibition.
DRIVE WHILE DISQUALI-
FIED
A Wingham man will be sen-
tenced September on a charge of
driving while disqualified.
Pickell said that on April 10,
police were dispatched to an acci-
dent in Morris Twp. They found a
car in the ditch, and an injured
female in the back. The plates for
the car were found in the ditch and
back seat, while there were two full
beers and two empties, also discov-
ered in the vehicle.
Upon investigation, police
learned the plates were registered
to a different car.
The victim, the accused's com-
mon-law wife, was taken to hospi-
tal. Rod Adams, who was not at the
accident scene, later spoke to offi-
cers at the hospital and admitted he
was the driver,
It was determined through the
investigation that Adams was not
intoxicated at the time, but that his
license was suspended until Febru-
ary 1999.
Defense Counsel Tom White said
that the passengers had gotten out
on the side road, then Adams went
up the road to turn around. Driving
back he suddenly saw one of the
passengers in the middle of the
road and hit the brakes, which
locked, causing him to lose control
and run into his wife.
Concerned that he would be
taken into custody and not be
allowed to go to the hospital with
her he left.
A request for any jail term to be
served on the weekend resulted in
delayed sentencing as there were
no cells available in Walkerton.
Adams was fined $100 for driv-
ing with illegal plates.
