Again, Carroll pointed out the legislation would empower the minister to restructure school boards and the election of trustees, but does not detail how the system would work after restructuring. The proposed legislation would also result in expanded rights for children to attend a particular school, according to the report. At the elementary school level, children could attend if a parent or guardian is a supporter. For sec­ ondary students, open access would continue between public and sepa­ rate boards, and supporters of a French-language board would have the right to send their children to either an English-language or French-language school. Other portions of the bill will not directly impact the HCBE because the recommendations are already in place. Advisory school councils must be established along with special education advisory committees. The minister would regulate the composition, function and opera­ tion of both groups. Boards have also been told in the legislation to appoint non-voting student representatives to attend board meetings. The HCBE is now in its third year of such an endeav­ our. The Education Improvement Commission, which is to be over­ seeing the restructuring of school boards, would have the power to hold in trust and transfer assets, transfer liabilities among district school boards, transfer employees between boards and require a board to provide services to another board. Carroll said there are more details to be determined regarding the regulation of assets, shared ser­ vices and other amalgamation issues. The finance aspect of education is still speculatory as Carroll was unsure how the government plans to deal with “sweatered” funds if underspent. The “sweatered” funds are to be earmarked for specific purposes, yet it is unclear what will happen to unused funds, he said. The financing with amalgamation is also under scrutiny as Carroll told of the shift of the fiscal year to match the school year. The current system has financial statements run by the calendar year. It will be moved to coincide with the September start of school. This leaves eight months for “stub year funding”, said Carroll. Revenue calculations will be based on 62 per cent of operating grants and property taxes, said Janet Baird-Jackson, superintendent of business. However, a large payroll goes out at the end of August because of teachers returning to the classroom, added Allan Carter, chair of the board and trustee for Hens all and Tuckersmith Twp. Carroll expects a $3,653,005 deficit at the end of the eight-month stub year. “With no way to raise taxes, (due to the new government funding model) we can only make up the shortfall by cuts,” said Carroll. Though pointing out many unclear and problematic parts of the proposed Bill 160, Carroll said the one good point was the confir­ mation of staff positions with the new board.
