In a case where eyewitness
accounts contradicted the techno-
logical and expert evidence, a Hul-
lett Twp. man was fined $850 for
driving with a blood alcohol level
above the legal limit.
Testifying he had had only six
beers between 4 p.m. and midnight
on the evening of Dec. 24, 1994,
Dwight Caldwell, 24, pled not
guilty to the charge.
The incident began at approxi-
mately 11:40 p.m., Dec. 24, when
Caldwell, a passenger in a car
stopped by a Clinton Police officer,
appeared to be passed out on the
back seat.
The officer later observed Cald-
well driving another car which
passed the cruiser.
After failing to respond to the
cruiser lights and running a red
light, the officer said Caldwell did
stop his vehicle and get out. He did
not appear to be staggering and
there were no physical signs of
impairment.
Questioning Caldwell's 'sleeping'
in the back seat, after a claim of
only six beers and working a mid-
night shift, Mr. Vale, Attorney for
the Crown, pointed out that Cald-
well would not have worked that
day, Friday, because of the holiday
and asked whether he usually suc-
cumbed to alcohol immediately.
Four witnesses backed Caldwell's
claim of only six beers and said he
parents, teachers, congregation and
minister taking part in these
readings.

For Caldwell's height, weight and
age, his blood alcohol level would
have been between 0 and 50 mg per
100 ml of blood, over the elapsed
time, testified Dr. Michael Ward, a
forensic toxicologist from Toronto.
To attain the tested level, he would
have had to consume nine to 11
beers.
The breathalyzer test revealed a
level of 140 mg per 100 ml, 60 mg
over the legal limit.
In sentencing Caldwell, Judge
R.G.E. Hunter mused as to why the
(defendant and -the witnesses)
would recall exactly the number of
beers he had to drink that night.
Citing no evidence that the road-
side breath test or the breathalyzer
at the police station were inaccurate
or not working, Hunter prohibited
Caldwell from driving for one year
as well as giving him six months to
pay the $850 fine.

The Auburn Women's Institute
meeting will be held on Thursday,
Sept. 21 at 2 p.m. at the
Community Hall. It is a mystery
meeting and there will be guests.
The meeting is in charge of Jean
Plaetzer, Evelyn Flett and Bernice
Anderson.
Also, the Auburn Institute
members are invited to St. Helens
Institute's 90th anniversary on
Monday, Sept. 18 at 2 p.m.
Pair mark 25th
Ruth and Tom Jardin spent
Friday evening at Belgiave
celebrating their son Harold and his
wife's 25th wedding anniversary.
Mr. and Mrs. Arnold McIntyre of
Sudbury visited with their uncle
and aunt, Tom and Mildred Lawlor
on the weekend.
Silver Tops
host dinner
The Auburn Silver Tops will
hold their pot luck dinner and
meeting at the Auburn Community
Hall on Wednesday, Sept. 20 at
noon.
Unbelted drivers are: 15 times
more likely to be killed. Five times
more likely to be hospitalized than
belted drivers.
Huron/Perth Injury Prevention Committee
The September meeting of the
Burns UCW was held at the
Londesboro United Church on
Wednesday, Sept. 6 with eight
members. Rev. Paul Ross was a
guest.
Hazel Reid opened the meeting
with a reading, "My Day Off'.
Hymn 500 was sung accom-
panied by Beth Knox at the piano.
Josephine MacGregor read, "The
House with Nobody in It". "Being
Part of Creation: was read by Beth
Knox, followed by The New Creed
repeated in unison. Hymns 501 and
502 were sung.

McPhee-Haist. Everyone is
welcome.

speaker is Mr. Rick Snell of
Mitchell. His topic is lawyer's
events of interest to women.
