Howick man goes to prison for sex assaults
A Howick man will be spending
Christmas behind bars after being
sentenced in Wingham's provincial
courts, Wednesday, to serve two
years less a day in a correctional
facility on charges of sexual
assault.
The offender, who can not be
identified to protect the privacy of
the three victims, now aged 16, 13
and nine, first appeared in Wing-
Sentencing for an Ethel-area
man, who pled guilty in provincial
court Wednesday to possession of
stolen property will take place in
Wingham Feb. 16.
Kevin Wernham, 38, RR1, Ethel,
entered a guilty plea Dec. 15. The
charges were laid after police dis-
covered a stolen 1988 flatbed trail-
er, valued at $12,500 and a 1989
Mack truck, valued at $40,000 on
Mr. Wernham's property, Oct. 15.
Missing was $7,800 worth of cher-
rywood lumber, which had also
been taken.
The items had been stolen Sept.
26 from Mississauga by two other
men, Crown Attorney Bob Morris
told Judge R.G.E. Hunter. Mr.
Wernham had acted as a go-
between for the sale of the lumber,
which was later recovered from a
Howick Twp residence. It had been
purchased for $5,600.
In his first appearance in court
Dec. 15 in Wingham, a 70-year-old
Ethel man pled guilty to drinking
and driving.
Presiding Judge R.G.E. Hunter
was told by Crown Attorney Bob
Morris that on Nov. 20 Wingham
OPP Constable Bob Morris had
noticed a car in a Morris Twp ditch.
The accused, David Lloyd Keffer,
he said, was beside the door of the
car, the engine was running and

Constable Randy Gaynor, 27,
must work for five days and receive
no compensation as the disciplinary
action determined by the force, on
Dec. 15.
This action was taken under the
Police Services Act.

Wingham OPP have charged a
Brussels-area man with failing to
remain at the scene of an accident.
The accident occurred in East

ney Bob Morris read statements
from the victims, describing the
sexual acts that had been commit-
ted. These included oral sex and
fondling and while penetration had
never taken place, intercourse had
in some cases been attempted.
The abuse had gone on for a
number of years.
Defense counsel Mr. Parled said
Mr. Wernham had first been con-
tacted by the two thieves when they
asked him if he knew of anyone
interested in buying the lumber. He
described his client's role as "at
worst, an accommodation party and
at best, a dupe." The truck was
deposited on his property, Mr.
Parled said and it was later that his
client came to the realization that
the property was stolen.
He submitted a psychiatric evalu-
ation indicating a condition from
which Mr. Wernham suffers.
In his defense Mr. Parled said
Mr. Wernham had not received any
proceeds from the sale, had entered
a guilty plea at the earliest possible
time and has been co-operative
with police. He has no related
record, Mr. Paled said, adding that
he felt his client's misjudgement
was a result of his underlying men-
tal illness.

impairment Const. Alexander asked
Mr. Keffer to come to the cruiser

test. Later breathalizer readings

record.

for 12 months he was fined $750.

After pleading guilty to a lesser
charge of driving with a blood alco-
hol level above the legal limit, Mr.
Justice Chester Misener fined
Const. Gaynor $2,000 and revoked
his licence for one year.
Justice Misener said of Const.
Gaynor, "You of all people should
have known better than to find
yourself in a situation such as this.
You are privileged to be a police
officer."
Const. Gaynor has been on the
force for only 2 1/2 years.

Miss Zehr escaped injury, the
spokesperson said.
The defendant entered a plea of
guilty at that time and a pre-sen-
tence report was scheduled for
December court.
In the report the man's pastor said
he believed that the offender used
his own translations of the scrip-
tures to deal with his family.
Defense counsel Alan Mills said
that he had to agree the man had a
serious problem, but asked Judge
Hunter to give consideration to the
fact that the man had by entering a
guilty plea kept the victims from
having to testify. Also, he noted
that there was no prior record and
that intercourse had not taken
place. Given these circumstances,
he said, he felt that reformatory
was more appropriate than peniten-
tiary.
Judge Hunter said that while he
did take the aforementioned into
account he emphasized the serious-
ness of the crime. "You breached
your trust as a parent. While there
may be no physical ramifications I
can only wonder at the mental

Three first time offenders were
placed on one year's probation after
pleading guilty in Wingham's
provincial court Dec. 15 to stealing
gas from a Grey Twp. farm.

by Jeffrey Voisin of St. Marys and
driven by Chris Teahen of Stratford

men pumped 53 litres, valued at

Mr. Morris said that the owner
saw them but not in time to stop

where he confronted them. The
three have made restitution and
offered apologies.
Judge R.G.E. Hunter granted a
conditional discharge before plac-
ing them on probation.
