Road may have been unlit but driver was, judge says A Brampton man wanted on a bench warrant for not showing up in court in November to face a drink driving charge, turned him­ self in to Judge R.G.E. Hunter in Ontario Court, Criminal division in Wingham Dec. 18. Carlos A. Sousa pleaded guilty to the drunk driving charge and had a charge of failing to appear in court dropped against him. A bench war­ rant for his arrest had been issued after he failed to appear for the Nov. 19 court. The court was told that on Sun- Drunk driving charge dismissed on clerical error day, Oct. 27 at 1:13 a.m. a car was seen travelling west on Highway 86 in Morris township, east of Wing­ ham. From the Management & Staff BRIDGE MOTORS Wingham 357-3460 0 I i I I i I I A Stratford man had a drunk driving charge against him dis­ missed after paperwork produced by the prosecution in his trial in Ontario Court, Criminal Division in Wingham Dec. 18 showed two dif­ ferent names. Judge R.G.E. Hunter halted the trial after the defence attorney for Richard James Winters of Stratford pointed out that one of two docu­ ments presented to Mr. Winters after his arrest gave his proper name, Richard, but another identi­ fied him as Robert. Earlier Theresa Pollard had told the court she had been patrolling on Highway 86, two km east of Blue­ vale on Aug. 22 at 8:05 p.m. when she spotted a vehicle travelling west towards her at a high rate of speed. She activated the radar and clocked the vehicle travelling at 109 km per hour. She turned and pursued the car and stopped it. Mr. Winters and his young son were the only occupants. When she talked to Mr. Winters, she said, she could detect the strong odour of alcohol. He was subsequently given a road­ side test which he failed, and was taken back to the Wingham O.P.P. detachment where he failed two breathalyser tests. But in filling out the document that gave the read­ ings, the technician on duty had typed in the name of Robert Win­ ters, instead of Richard Winters. track. Wingham O.P.P. approached the vehicle and found Mr. Carlos in the driver's seat. When he got out of the car his speech was slurred and he was unsteady on his feet. When a demand was made that he take a roadside breath test, he refused, even though he was warned that refusing to take a test brought the same penalty as taking the test and failing. Duty Counsel John Schenk said Mr. Carlos admitted to having had a drink but that it was his first time in the area and the road was unfa­ miliar to him and the curve was unlit. "Sounds like he was lit", Judge Hunter replied and sentenced Mr. Carols to have his licence suspend­ ed for 12 months and pay a $750 fine. ^Behold the Iamb of tod../' John 1:29 We wish you all a safe and secure holiday.
