Bly th man loses licence A Blyth man was fined $750 and lost his licence for a year when he pleaded guilty in Ontario Court, Criminal Division, in Wingham January 23 to driving while having over the legal limit of alcohol in his blood. Paul R. Pierce of Queen St., Blyth, pleaded guilty to driving with over 80 mg. of alcohol in 100 ml. of blood. The court was told that Ontario Provincial Police Con­ stables Thompson and Pallard were conducting a RIDE check on Queen St., Blyth on December 23 when they saw a car pull onto the street from Wellington St., pull to the side of the road and turn the lights off. They approached the car and questioned the driver, smelling the odour of alcohol. They discovered a part bottle of alcohol on the floor of the back seat. Mr. Pierce was requested to give a breath sample and failed then was taken for a breath test at the police station which he again failed. Judge R.G.E. Hunter sentenced him to the standard $750 fine and 12 month licence suspension. A. Wingham man who pleaded guilty to one count of break and enter, one count of mischief, and one count of breach of probation was handed a 12-month sentence by Judge R.G.E. Hunter when he appeared in Ontario Court, Crimi­ nal Division in Wingham January 23. Gary R. Carter, Centre St., Wingham pleaded guiity to charges of mischief in the damage of a public pay phone and a break and enter at the Sportsman Club, RR 2, Wingham. Acting Crown Attorney Liz Maguire told the court that on Nov. 10, 1990 Mr. Carter and another person were seen by Wingham Police at the entrance of the Wingham Town Hall. Just after­ ward, police passed again and saw the telephone lying on the ground. Others also witnessed Mr. Carter and another man in the area just before the phone was damaged. Ms. Maguire said repairs to the phone cost $929.35. On September 21 the side door of the Sportsman’s Club was forced open and four or five cases of beer were removed. Damage to the door was $50. The accused later admitt­ ed to police he had taken part in the burglary. Since Mr. Carter was on proba­ tion from a number of other crimes he was also charged with breach of probation. Ms. Maguire revealed that Mr. Carter had been convicted of three counts of mischief, two counts of break, enter and theft and three further counts of mischief in 1989. In light of that, she suggest­ ed, a sentence of 60 days consecu­ tive on each of the three counts would be appropriate. But Judge Hunter had his own ideas. ‘ What do you expect me to do?” he asked Mr. Carter, who gave no answer. ‘‘We’ve reached a point where it’s strictly (a case of) specific deterence,” he said. He sentenced Mr. Carter to six months for the break and enter and three months each for the mischief and the breach of probation charges for a total of 12 months.
