The board's lawyer, Warren Seyfert, told the Sentinel Monday, he doesn't believe the board's concession to the ministry's order to close .the 'beds will jeopardize their legal action. The arguement before the courts has nothing to do with conceding to the ministry orders said Seyfert. Prudence would say anyone can have the best legal case in the world and not win, .said Seyfert. It: is better not to go into an irreparable situation in the meantime he added. Seyfert cited the . example of another hospital which_was forced to close because it did not have` the money to operate, when the health ministry ordered hospital closures several years ago. When the ministry's decision was overthrown by the courts, this hospital held a grand re -opening... Their decision to closedid not have any bearingon the court's ruling that the .hospitalshould be. allowed '" .to ,' remain open, . according to Seyfert. While the minister has the 'right toclose beds, it is his duty to provide the best health care possible, said Seyfert. If a hospital has half of its beds laying empty for eight monthsofthe year, the minister has the right toclose those beds because they are not required, suggested Seyfert. But the minister is required to determine the needs of a community. A:ratio cannot be drawn,up. and applied everywhere, he commented. Seyfert said the case of Metropolitan 1 Hospital in Windsor differs from Wingham's case because Metropolitan was trying to get the ministry to open beds because of an emergency. The court's decision went against Metropolitan Hospital. Wingham is asking the court to issue a declaration saying what the minister did in closing the beds was unlawful. "The health ministet should be consid- ering health matters," said Seyfert, "not deciding how ,much money a hospital can have:" Financing should be determined by the finance minister, and then the health minister should provide the best health care possible for the .money available, not the other way around, he observed. 1 e. She resided at her Kinloss home until August of 1976 when she became a resident at Pinecrest Manor. Mrs. MacKinnon has a family of four. children,. Fras- er MacKinnon and John MacKinnon Of Kinloss Town- ship; Grace, Mrs. Orviile El- liott of Lucknow, and Jean, Mrs. Ross MacKenzie of Amberley.
