non-payment of rent and damages to
the rented dwelling.
Perhaps the most significant
changes introduced with the new
Icgislation relate to the rules about
rent. The law now permits a landlord
to charge a new tenant under a new
tenancy agreement a "market rent",
without being restricted to the
"maximum rent" for the unit;
however, if the tenant rents a site for
a mobile home which the tenant
owns, then the new rent must be set
in accordance with the regulations to
the statute.
Once the tenancy agreement is
entered into with a new tenant the
landlord will be restricted to rent
increases equal to the government's
annual statutory guideline. Where a
landlord seeks an increase over and
above the statutory guideline there
arc certain circumstances provided
for in the legislation for doing so.
The Ontario Rental Housing
Tribunal which is responsible for
administering the legislation operates
from a series of regional offices
throughout the province. In addition,
they are making use of local Driver
and Vehicle Licensing Office
administered by the Ministry of
Transportation to disseminate
literature on the new Act and also to
serve as document filing centres for
landlord and tenant applications.
Rural property owners that rent
out farm dwellings or sites for mobile
homes should familiarize themselves
with the new rules, particularly the
landlord's rights and obligations
arising out of the new legislation.0
