relationship with MNR, didn't have
anyone in attendance.
Behind the words lurks a touch of
the emotions that run high when
there is a dispute like the Warwick
Drain. McBride, who is secretary of
the provincial drainage engineers
association, says the group wants to
see the laws applied in the same
manner across the province.
Angered by the delays, the township
has taken the issue to the Ontario
Drainage Tribunal. They were
encouraged by a letter last summer
from the Tribunal's chairman,
Bernard J. Goodal who said "We are
of the view that the Ministry of
Natural Resources has no authority to
demand a modification of the
drainage works as designed by the
engineer. The drainage works can be
constructed as the engineer has
designed them." The township is now
awaiting Goodal's official ruling on
the drain after one of the landowners
appealed his assessment. The
township also wanted a ruling on
how the additional costs caused by
the MNR's actions should be
assessed. There have been extra
engineering costs for the project and
the flurry of additional meetings has
driven up council per diems. Some
participants also worry that when the
contract is finally let, the work will
cost considerably more than if it had
been done in 1994 because
contractors' prices have risen.
But Bennett claims the costs
could have been avoided.
"There was an eight or nine-
month process that shouldn't have
happened because people thought
they could challenge the Fisheries
Act," he says.
Fred Brewer doesn't care how the
decision goes as long as people get
on with it. He looks after the farm for
his uncle, 101 -year-old Charles
Brewer who, thankfully, hasn't been
aware of all the fuss. He has a CURB
grant approved which would allow
him to fence off the drain if it
remains open, keeping the horses on
the rented pasture out of the water.
He'd just like to get on with the work
and worries that the change in
government might leave him without
a grant if things don't move more
quickly. He shrugs his shoulders and
figures it's all out of his hands.0
