derive the majority of his income from
the farming operation, and must have
been farming for the past 20 years.
Under the proposed changes, no farm
retirement lots are to be allowed in any
designated Niagara Escarpment land.
The administration of the NEC was
recently moved from the Ontario
ministry of municipal affairs to the
ministry of the environment. "The
current philosophy is that the NEC
land should be preserved as it is," says
Betts. "But the very title of the
Niagara Escarpment Planning and
Development Act indicates that there
should be some compatible develop-
ment allowed. Major development has
occurred in the southern areas such as
Hamilton -Wentworth and Peel. There
are instances where 12 severances
have been granted on an original
township lot," he says.
The NEC Act calls for a review of
the NEC plan every five years. "Dur-
ing this review, an extensive process
takes place, similar to the steps that
were used to develop the NEC plan in
the first place," says Murray.
"First, the staff of the NEC
prepared preliminary papers stating
their position and made recommen-
dations to the NEC on changes which
they think should be implemented in
the NEC Plan. These preliminary
position papers are selected by the
Commissioners, and they are either
adopted, amended, or refused. These
commission papers in all cases are
recommending tighter control and less
development in all areas of the plan,"
says Murray.
The process by which the NEC
conducts the review process involves
several steps. First, the staff of the
NEC prepares a preliminary paper for
the Commission. The Commission
adopts this position, and this paper
goes to a hearing officer who conducts
public meetings, where anyone has the
right to make a presentation.
The hearing officer prepares a
report after the public hearings and
sends it to the Commission. The NEC
adopts a final position, which is
submitted to the ministry of the
environment. The Ontario Cabinet
will make the final decisions.
