PAGE 20. THE CITIZEN, WEDNESDAY, AUGUST 2, 1989. Cowie gets 14 days for drunk driving charge Lenard Cowie, RR 1, Wingham, received a 14-day jail sentence and had his licence suspended for two years when he was found guilty of drunk driving Wednesday in Pro vincial Court in Wingham. Mr. Cowie, one of two men charged with arson in the burning of the Brussels Legion last sum mer, was convicted of impaired driving and having care and control of a vehicle while having an alcohol level of more than 80 mg. per 1000 ml. of blood in an incident August 5, 1988. In the trial, Bruce Corrigan, RR 1, Bluevale, told the court he and his wife were awakened about 4:45 Business and Professional Directory a.m. Aug. 5, 1988 by an unidenti fied noise from nearby Highway 87. They got up, dressed and went to investigate. They found a car off the side of the road and found Mr. Cowie walking on the road. Mr. Cowie asked to be driven to the Wingham Ontario Provincial Police Station which Mr. Corrigan did. Constable James Cook testified he later went to the scene of the accident and measurements show ed Mr. Cowie’s vehicle had gone off the road, 112 metres through a field, over the Corrigan driveway, through another 88 metres of field, through a fence twice, and back onto the highway. Constable Glen Trivett, who conducted the breathalyser tests, testified the readings were 173 mg. and 167 mg. and that Mr. Cowie couldn’t do some of the physical dexterity tests because he was too drunk. At one point he fell out of his chair and fell asleep on the floor. Defence attorney David Miller of London argued that because it was an hour and fifteen minutes after Mr. Cowie arrived at the police station until the tests were taken, Mr. Cowie’s rights were violated’ but Judge R.G.E. Hunter didn’t buy the argument, saying he felt the police acted as quickly as they BLAKE Septic Tank Service Fast Efficient 24 Hour Service CALL RAY 887-6800 could given that the equipment had to be set up at that early hour of the morning. “There’s not the slight-, est doubt in my mind the accused was impaired,” he said. A second charge of taking a motor vehicle without permission was withdrawn. Meanwhile Robert Killick, the other man charged in the Brussels Legion fire, will remain in custody until Aug. 30 when his plea will be heard on a number of charges unreleated to the original incident. The two men will appear in court in Goderich Sept. 19 for a trial before judge and jury regarding the Brussels charges. GENERAL J.
