Amendments to divorce act
Minister of Justice and Attor-
ney General of Canada Pierre
Blais has announced that impor-
tant changes to the laws gover-
ning child custody and support
orders have received Royal
Assent.:
The amendments simplify . the
procedures for obtaining a child
custody or support order, or
having an. existing 'one altered,
when the former spouses reside
in different provinces.
They will now be able to ob=
tain support orders through a
procedure, involving courts of
both .provinces. And where par-
ties are obtaining a support order
for the first time after a divorce
is granted, the application no
longer has to be , made in the
province where the divorce was
granted. ,
Other changes improve' access
to data which may help locate
individuals alleged to have ab-
ducted a child. Police will no
longer be required .. to obtain
permission from the courts to
apply toaccess federal
databanks. .
In addition, garnishee. sum-
monses for support payments
will now be valid for five years,
instead of just one.
"These amendments take .into.
account the more difficult
realities that today's divorced
and separated couples must ,
face," says Minister Blais.
"Children and spouses who
depend on some form of support
will benefit from a reduction in.
red tape and better tracing and
garnishment systems for support
payments."
