a small joint bank account with his
wife.
He reiterated he had reitived no in-
structions as to the !woks when be
took over the office In 192S.
Mr. 8edgwlck produced a casts book
in which Mr. Robertson bad entered
a list of his collections in 192.8, which
totalled 125365(If). This amount In-
cluded arrears of general taxes and
road oil for the years 1123-s.
Mr. Robertson said he had circular-
ised tax delinquents. Teo forms
shown by Mr. Sedgwick were recog-
nised by the. eitne•ss as circulars he
had used, but they were not sent to
everyone In arrears.
"Why did you not scud one to every-
one?" he was asked.
Mr. Robertson said he had received
instructions not to send the circulars
to the "poor and struggling" and to
"those with friends higher up."
Accused testified that when he at-
tempted to collect taxes from one per-
son
erson he had been shown a receipt which
was perfectly in order, yet the name
did not appear on the cash book or
the roll.
"What did you dol" asked Mr. Sedg-
wick.
"I credited him on the roll." was
the reply. The amount was 4137.21,
representing a year's ta.toP.
"What did you do about the money
end of it?"
"I put It In out of my own pocket-"
"Did you have that much on you?"
"No, I borrowgpLiL"
"Did yon not later find a surplus In
your hank amount of about that
amount?'
"Then how do you account for the
missing cashes'
"1 can't account for iia I can't un-
derstand It."

Mr. Robertson said 1t was his cus-
tom to enter payments first on the
roll, then on the cash book, from nota-
tions on receipt stubs, and he was un-
able to account for the fact that some-
times Items appeared in the cash took
and not In the roll.
"The stubs of many years are kept
lin the office," be said.
Court adjourned at 10.35 until

Mr. 8edgwlck resumed his crose-ex-
awinatlon at 10 o'elock Wednesday
morning.
With regard to tax payments re-
ceived by Mr. Knox, if witness hap-
pened to be atn.ent, he said he (wit-
nessl always found cash with the re-
ceipts when be returned to his °M e.

Mr. Sedgwlck also produced a let-
ter to the council, signet by -Robert-
son, wherein he stated he had sent
notices to everyone in arrears. The
letter was dated November 20, 1931.

he admitted (bat, as he bad not done
so. his letter wan a "false and mis-

N. S. F. Mews Were Paid
Witness said he could not remem-
ber any N.B.F. cheques which were
not 'eventually honored. Ile said he
tried to watch that stubs were nut
posted 1n the cash book before N.S.F.
cheques were honored.
To Mr. Shaver on Wednesday affer-
noon Mr. Robertson vehemently ex-
claimed that every cent of money he
cotleeted went in his cash drawer and
was subsequently banked, then trans-
ferred to the treasurer.
Aa secretary -treasurer of the fall
fair board Mr. Robertson said he had
had bookkeeping difficulties, and had
rweived from tine board a cheque for
a "mailman, as he had banked too much
money in the Lair account.
Mr. Robertson said, when questioned
by defence counsel, that be did not
consider it necessary to rend arrears
notices to a taxpayer who was • slow
but consistent payer.

Mrs. Jeesle M. Robertson, wife of
accused, Bald her husband bad no as-
sets, that he had lived within his sal-
ary as tax gollector, and that any
expenditures this year had been made
with her money from their joint bank
account.
Witness told the court her husband
bad been delirious during his illness.
His Honor Intervened when Mr. Shaver
asked the witness' 1f her husband had
ever said anything relevant to his
ease while delirious.
"I am Irish and I do not believe 1n
dreams," said Judge Costello.
A. M. Robertson, municipal auditor
and retired school teacher, and Wm.
Bailie, J.Y., were called by the defence
1 and each gave testimony to the Integ-
ray and clean living of the aceuaed
man.
"I would be glad to bear the argu-
ments both for the defence and the
Crown," said Judge Costello, at the
conciueion of the evidence, "but I am
not going to give a decision In this
matter today."
