Hunter threw out a charge against a Kitchener man for driving with over 80 mg. of alcohol in 100 ml. of blood in provincial court in Wingham Wednesday. Fred Oram Herd of Kitchener had first appeared before Judge Hunter at the March 28 session of court, prepared to plead guilty to the charge. As the facts were being read out however. Judge Hunter stopped the proceedings and told Mr. Herd he might have a good chance of avoiding conviction and advised him to talk to a lawyer. Later, Mr. Herd changed his plea and trial date was set for July 25. Wednesday the court was told by Mr. Herd’s wife that she was sleeping in a room at the Wingham Motel where she, her husband and her step son were staying, when she awoke and saw that her car was gone. She phoned police and she said knew that her husband and step-son had taken the car and she wanted them to bring the car back but didn’t want charges laid. Constable James Cook said he had received a call at 1:40 a.m. March 13 from another police force to investigate the missing car. He travelled south of Wingham and spotted a car on the east side shoulder of Hwy. 4 near the bridges just south of Wingham. He pulled up behind the vehicle and found two young men in the back seat but no one in the front seat. While he was standing beside the car however, two other men ap proached the car and the older of the two men who identified himself as Mr. Herd, approached the driver’s side. Constable Cook said he could smell alcohol on the man’s breath and asked if he had been drinking. “Yes I have been”, he quoted Mr. Herd as saying. Constable Cook asked Mr. Herd if he had driven the car to that point. “Yes, I did. I’m not going to lie to you”, he quoted Mr. Herd as saying. Under cross examination by de fence counsel Brian Linley, Con stable Cook said the car was not running at the time. When Const. Cook stepped down Crown Attorney Kevin McHugh I’ CLASSIFIED ADS^ F. Seaforth: 527-0794 London: 432-1841 O SunLife sentence A Chepstow woman received a suspended sentence Wednesday in Provincial court in Wingham for an attack on her sister while they were settling their father’s estate in Brussels. The court was told that Anne Marie VanLanduyt, RR 1, Chep stow was with her sister Brenda Mary Biesinger in the shop of their late father in Brussels on June 10 when an argument broke out. Mrs. VanLanduyt struck her sister in the eye with a fist then struck several more blows. Mrs. Biesinger fell backwards onto a pile of scrap and her sister jumped on top of her and started hitting her some more. Mrs. VanLanduyt had to be pulled off by the victim’s husband. Duty counsel George Brophy explained to Judge R.G.E. Hunter that it was an emotional time for Mrs. VanLanduyt. She and her son had recently sought assistance from the Children’s Aid Society of Bruce County because of the distress her son was feeling over the loss of his step-father and his grandfather in a boating accident. The violence seemed out of charac ter with the character of the accused, he said. He explained that normally the sisters did not see each other and this was their first contact for some time and they would not be seeing each other in the future. Judge Hunter agreed there seemed to be special circumstance involved and gave Mrs. VanLanduyt a suspended sentence and 12 months probation BRUSSELS Open 6 Days A Week __ Mo8naar“a¥\7TT TFriday nights until 9 >> I I - I _ J B W VOMMUNITV Brussels MARKET RED OR GREEN Cabbage 69 1 LITRE TETRA VILLAGE SOFT Margarine ALLEN’S PURE We reserve the right to | limit quantities __ Prices in effect July 31-August 4, 1990 While supplies last!
