Driving offences send 4 Huron men to j ail *6 It was a bad day in provincial court in Wingham January 24 for second-time offenders found driv­ ing while impaired, or found driv- ing while their licences were under suspension as no less than four men were sent to jail. David Franken, RR 2, Auburn Top showman Junior Dairy Showmanship winner Ryan Hallahan was presented with this trophy last Wednesday evening at the Brussels Agricultural Society’s dinner by Pres. Jim Hunter. Mr. Hunter also donated the trophy. who had been found guilty in November of driving while his licence was under suspension was sentenced to 60 days in jail. Mr. Franken had argued that he hadn’t been driving the vehicle the night in July 1988 when his vehicle had been stopped by police. However Judge Hunter hadn’t believed the story that his girl friend was driving the vehicle and had found him guilty. Sentencing had been postponed until January because Mr. Franken was expecting to be laid off at this point but since he isn’t being laid off after all, he was granted a temporary absence program to let him keep working. An automatic two-year driving prohibition accompanies the conviction. Also getting a two-year prohibi­ tion and getting a 14-day jail sentence was Frederick Krohn, RR 3, Wingham. The court was told Wingham police saw a van driving eratically about 11:18 p.m. on July 14, 1989 and when they stopped it, the odour of alcohol was smelled from the driver. When the driver was administered a breathalyser test he had over 80 mg. of alcohol in 100 ml. of blood. The court was told he had a prior conviction for the same offence dating from April 9, 1986. Brian Searson of Bluevale re­ ceived no less than two sentences for two separate occasions of being caught with over 80 mg. alcohol in 100 ml. of blood in just over a month. The court was told Mr. Searson was first stopped Oct. 13, 1989 in Lowertown Wirjgham and found to be over the limit. The same OPP officer stopped the man on Nov. 25, 1989 in Wingham and again failed the breath test. Duty Counsel Alan Mill told Judge Hunter that Mr. Searson had been employed until recently and said the two stops put him in “a very unfortunate circumstance.” “Unfortunate!” Judge Hunter snapped, “It was stupid to be caught a month apart on the same offence.” He sentenced Mr. Sear­ son to pay a fine of $750 and have a 12-month driving prohibition on the first offence, and a 21-day jail sentence and a two-month prohibi­ tion on the second offence. Judge Hunter reconsidered his original sentence to Kelly Mc­ Glynn, RR 2, Bluevale for driving while his licence was under suspen­ sion, and reduced the jail sentence. Mr. McGlynn had pleaded guilty in court on Nov. 22, 1989 and the court was told that Wingham OPP had stopped a three-wheel all- terrain vehicle on Oct. 26, 1989 in Turnberry township. When they checked, they found the licence of the driver had been suspended on January 5, 1989. Judge Hunter said Wednesday he would take into account the guilty plea “but that’s about all that can be said for you.” He sentenced Mr. McGlynn to 60 days in jail to be served on weekends and added “You were told while in court not to drive a motor vehicle for a period of a year and that’s exactly what it meant.” Business and Later, however, the Judge re­ considered and asked that Mr. McGlynn be brought back from the holding cells of the Wingham Police Station next door. On reflec­ tion, Judge Hunter changed the sentence to 45 days in jail. Fight at party brings conditional discharges Two young men who got involved in a fight while attending a party in Brussels received conditional dis­ charges and were placed on proba­ tion when they appeared in Provin­ cial Court in Wingham on Wednes­ day. Jeffrey L. Pletch of Belgrave and Ian Robb Johnston of RR 2, Bluevale pleaded guilty to creating a disturbance. The court was told that OPP Constables Shaw and Ramsay of the Wingham detachment were on patrol in Brussels about 12:45 a.m. on Dec. 9, 1989 when they saw a large crowd gathered at the corner of Elizabeth and Thomas Streets. The two accused were in the middle of the street surrounded by the crowd, fighting. Duty counsel Alan Mill told Judge R. G. E. Hunter that the two had had a disagreement while attending a party in a nearby house. Judge Hunter gave the two conditional discharges so they wouldn’t have criminal records and placed them on 12 month proba­ tion.
