N0A 1A0 (416) 765-6782. 05-lp Judge changes mind, gives lenient sentence A Brussels man will not go to jail for drug trafficking despite a warning from Judge R. G. E. Hunter before Christmas that he likely faced a jail sentence. Judge Hunter chose to fine Steven E. McCauley of Brussels after reading a pre-sentence report that portrayed him as a fine young man with a good family background who was in trouble for the first time. Defence attorney Michael Don­ nelly pointed out the fine family background in his arguing for a fine and probation instead of the jail sentence Judge Hunter had indi­ cated was likely to happen after Mr. McCauley pleaded guilty in provincial court in Wingham Nov. 22. At that time the court was told Mr. McCauley had met an under­ cover female OPP officer at a bar in Listowel on July 23, 1989 who had asked him if he could get some drugs for her. He took her back to his Brussels residence at 2:30 a.m. where he sold her a piece of cannabis resin for $140. Mr. Donnelly told the court that this was an isolated incident; that on three other occcasions the same constable had contacted him seek­ ing to buy drugs but on all those occasions he had turned her down. On this occasion he had just been trying to do a favour for a friend, not traffic in drugs, Mr. Donnelly said. He suggested a fine of $1,500 and probation. Federal prosecutor Jamie Grant agreed that a jail sentence might not be the most useful under the circumstance. Judge Hunter said he took into account the guilty plea and the joint submission of defence and crown attorney in deciding against a jail term. “I think I indicated to you before Christmas a likelihood you’d go to jail,” he told Mr. McCauley. “More often than not people do when appearing in this court.” However, he said, taking into account the guilty plea, the good background and the relatively small amount of the drug involved, he was going to sentence him to a fine of $2,000. He also put the man on probation for 12 months and told him to take counselling as recommended by the probation officer for alcohol and drug abuse. Thefts: Between May 12, 1988 and May 13, 1988 a thief or thieves entered a residence of 15 Toronto Blvd., Vanastra, Ontario by forcing a basement window while the occu­ pants were away, effecting a move to another residence. On their return they found a grey coloured Electrolux vacuum cleaner, Ser. #F99638E, Model 2106, missing. A local farmer found a bin of corn pulled a disappearance act between November 4, 1987 and September 20, 1988. The six tons of corn was delivered to a Hullett Twp. farmer and put into a bin at part lot 23 Cone. 14 Hullett Twp., by Snell Feed and Supply on Nov. 4, 1987 and on Nov. 20, 1988 the corn was gone. VANDALISM THEFT: Windows were smashed at the Vanastra Public School between March 6, 1987 and March 8, 1987. A 38” x 24” window leading into a room used to teach nursing was broken and someone entered the school and stole: 1 - 16 mm Bell and Howell projector, Model - Auto load Film­ sound #1552, Ser.# RS8192, Cones­ toga Ident. #8027070. 1 - cord from an Olympia calculator 1 - Pet computer/monitor com­ bination, black and white in colour, 400, 32k of memory.
