The OFA has been pushing for this legislation for the past 20 years. The new Trespass Act includes a fine up to $1,000.00 for trespassing, an increase of $900.00 from the old law. Offenders convicted may be ordered to pay up to $1,000.00 for damages. Under the old act, civil action was required to collect compensation for damages. Under the new Occupiers' Liability Act, owners have "a duty of reasonable care" to make sure the premises are safe - to avoid acts potentially injurious to other persons. However, owners are free from this "duty of reasonable care" if the person enters at their own risk, trespasses, or is in- volved in a recreational activity where no fee is paid.
