hard to believe, however.
“Have you never put the child to
bed?” Hunter asked. “Is there any
reason you couldn’t have picked up
the child and put him to bed instead of
waking your wife to do so?”
Koetsier said he could have but the
location of the bed against the wall
would have made it difficult.
Morris described this as just“another example of your entitlement,the same as with the TV show.”For his part defence counsel Mr.Ritter questioned the victim’s motives.She admitted under questioning thatthe marriage was troubled and that shewould like to return to her family in
the United States. She also admitted
that she had struggled with depression
and had fears that Koetsier might try
to gain custody of their son.
Ritter noted that she had been vague
in the details of the first incident,
arguing that his client, who pinpointed
the date as April 2006 had given an
explanation that couldn’t be rejected.
He also said that in the second casethere was no reason for his client toeven try to wake his wife if, as shesaid, she was in the spare room.“We’ve heard it was common practicefor her to sleep with the child. Whyslap her now? Her version makes nosense.”
Hunter said he doubted Koetsier’s
claim that he had not touched the
victim in the first incident. “It defies
logic. While there was no striking he
pushed her and that constitutes an
assault.”
The second incident began as a
result of what Hunter called a “rather
odd situation, where for some reason
Mom is the only one who can pick upa sleeping child and put him to bed.”“On a scale of one to 10, though Ihate getting into the seriousness, bothof these are at the low end,” he said, ingranting a conditional discharge witha one-year probation period. Koetsier can possess no firearms
until his probation ends.
HEARING
A plea from the victim failed to
sway Hunter in a hearing for a
variation on a no-contact probation
clause.
Probation officer Deb Singer
advised against Paul Martin and the
victim, who have both a romantic and
a business relationship, being allowedcontact before he completescounselling. Martin was sentenced tojail for an assault on the victim. Singer noted that Martin had ahistory of domestic assault and feelshe needs intensive counselling. The victim said she believed
Martin, who has had some
counselling, is changed. She said
contact would be a business and
emotional relief for her.
Hunter told them to come back Aug.
16 and if Martin had completed the
recommended program satisfactorily
he would amend the probation
order.
