County red tape
Building permits raised at council

Huron County may find, out
very, soon whether or not the
municipalities have been able to
issue building permits under the
National Building Code. Planning
director Gary Davidson warned
Friday at county council's May
session that some legal advisers
say the municipaliteis cannot
issue building permits unless
they have passed the necessary
bylaws enforcing the Ontario
Building Code Act: of 1974.
"We may have a challenge in
Colborne Township very soon,"
said Davidson. "Then we'll
know."
In Londesboro recently, county
planner Roman Dzus told the
Huron County Municipal
Officers' Association annual
meeting that unless a municipa-
lity has passed a bylaw enforcing
the Ontario Building Code, it has
no legal basis to charge for, or
issue a building permit'. Dzus said
at that time the Ontario Building
Code Act of 1974 is the only
legislation that can be used to
control construction in a munici-
pality.

Teledyne Explorations Ltd., the
company which explored for oil
and gas deposits in the area last
year, has started testing farms in
McKillop Township.

in Vanastra, said the company
was carrying out explorations
across farms north of Winthrop
beginning last week.
Mrs. Lorne Glanville, R. R. #4,
Walton, said the Teledyne crew
had drilled a number of test holes
ill) their, farm and on the
neighbouring Ryan -farm.
She said the crew were very
good and didn't drive all over the
fields. She said they made one
path, and "they do respect the
crops."
She said farmers were compen-
sated for any possible crop
damage and that the oil drilling
was "no bother."
Mrs. Glanville said last year
the crew dug a number of test
holes along roads in the area arcr
that one of .the crew told her
husband the decision to test for
oil on the farms "was a pretty
good sign that there is oil
someplace."

puts the municipalities in a
position to carry out the responsi-
bility the Ministry gave them in
' 1974," Davidson told council.
Davidson did agree with
Turnberry Reeve Don Eadie that
it will cost the local municipalities
more to comply with the Ontario
" Building Code Act Davidson.
"said there is no doubt the
Ministry has passed the costs and
the responsiblities of building
inspection along to the munici-
palities.
"If the Ontario government's
requirements are not met, the
municipality can be held liable,"
said Davidson. The planning
director went on to explain the
Ontario Building Code ,Act deals
primarily with structural matters.
Things like faulty roofs and leaky
basemcnts and poor quality
flooring just don't come under
'thic• Act.
Two amendments to the
county's official plan, one in
Hullett Township and one in
Blyth, stirred some comment
among councillors. Hullett Reeve
Johu Jewitt said he is concerned
about the costs which must be
paid by individuals to obtain a
simple zoning change. He said
each of the' two citizens inthese
specific cases paid about $1,300
to hire "outside help".
"I'm concerned about the red
tape and the paper work we are
putting in their w'ay," argued
Jewitt.
Cost Passed Along
Planning director Gary
Davidson said at one time, the
planning department did all that
work for citizens in Huron
County, but that the costs are now.
passed along to the individuals
requesting amendments to the.
official plan. He said tins work
must be done properly in the first
instance, or it gets bogged down
when it reaches the Ministry
office,
Jewitt retorted he was not
opposed to costs being passed
along to individuals. He did say,
however, he was concerned about
the "red tape and paper work in
what should have been a very
simple operation".
Reeve Bill Elston, Morris
Township, agreed. Elston said,
"Slowly but surely we're grinding
private enterprise to a halt."
"Surely there's a different
approach," said Elston. He
complained that the rights of
individuals are being hampered
by government controls.
Warden Gerry Ginn said' that
too often, people consider that
planning is right for others...but
too restrictive for them as
individuals. Ginn asked council to
consider the situation where a
resident wanted a change in the
zoning, from residential to
commercial.
Ginn suggested that the same
individual who resisted the inter-
vention of planning processes for
a simple rezoning problem, might
insist that planners do something
about the farmer that wanted to
build a hog barn beside his place
of business.

This is an election year for the
municipalities and when nomina-
tion time rolls around. , Goderich
will be responsible for the
nominations for the election of the
separate school trustee for the
northern half of the county.
County council learned Friday
this change is a result of the town
of Goderich now having a higher
separate school assessment than
the Township of McKillop, the
responsible municipality in 1976.

The changeover to the metric
system is causing the Huron
County Planning Department
some concern. The Ontario
Ministry of Housing has
reminded the planning depart-
ment that as of July 1, 1978, all
planning documents submitted to
