enter upon the enquiry, retnrneble on
the dtkb of May. 1913, but learning
that. John W. Moyes, whoas presi-

r.aupany's altairs, wax absent front

mony little progress could be made,
the appointment was enlarged sine
die. Another appoin:utent was taken
out returnable un the 12th of Sep-
tember, 1913, and on its return the
general course of procedure to be fol-
lowed was decided on. Sittings of the
board for the taking of evidence were
held in the year 191:1 on the letb of
September, :loth of October, 3uth and
21st of Novemher, and in the year
1914 on the Lith, 7th, 19th end 21st of

number of witnesses were examined,

The relevant sheets of the ledger ar-
counts of the several banks in which
the cuwpany's financial business has

the officials having custody r.f them.
j These, with the testimony of the ail-
. cert of the trust parry, showed
that the guarantees) bonds had been
*old, the proceeds deposited wit h the
trustee, and by the letter paid over to
1 Moyes representing the railway com-
pany. But teethe, the bank book.,.
nor the testimony of the trustee's of--
fleers disclosed the ultimate destin

COUGH TWO. YEARS OLD
Yields to Vinol. Read Why.
Strong vigorous men and women
hardly ever catch cold; It's only when
the system 1s run down and vitality
low that colds and coughs get a foot -
bold.
Now Isn't it reasonable that the
right -way to cure a cough is to bulld
up your run down condition again?
Mrs. D. A. McGee of Waycross*, Ga.,
says: "1 had a chronic cold and cough
which kept me awake nights for two
year. and I felt tired all the time.
Vinol cured my cough and I feel
stronger In every way."
The reason Vinod la so emlcactous
1n such cases 1s because It contains
In a delicious concentrated form all
thea medicinal curative elements of
cod liver oil, with tonic, blood build-
ing iron added.
Chronic coughs and colds yield to
Vinod 1 ecause it builds up the weak-
ened, rundown system.

'mune must be bad to the books,

words of the •loopeny. Both Mr, Mao-
Ewss, the secretary, and Mr. Roberts,
the en Beer of the company, declared
that all the boots and papers of t►s
company, that at any time had been
In their possession, bad been delivered
by them to tiles president, John W.
oyss. To Moyes, accordingly, whose
attendance for examinatoo had been
procured with some difficult and
after a long delay, the (ward looked
for discovery of the facts. In this,
however, the board was disappointed.
While bis memory refused to recall
with accuracyIndividual transactions
recorded in te bank ledger", even the
application of a cheque for so large an
amount as 415,000, the totally unex-
pected and diseoocertlog turn which
his testimony took when asked to pro-
duce the company's hooka and papers,
promised to land the investigation in
an impasse from which three seemed
no escape. k few extracts hour the
notes of evidence will test illustrate
this, and shoe the unsatisfactory
character of Moyes testimony, which
throughout was cbarrcterized hy shif-
ty evasion, and es ruheequent develop-
ments proved, by bull reiterated false-
hood. tluestiooeed by Mr i'roudfoot,
the folluwing answers were elicited
(tow Mr. Moyes:
I believe you were president of the
Ontario West Shore Railway Com-
pany
i war.
Io you still occupy that position ?
No.
\Vhn is president now ?
1catinge. pay.
Wben did you cease to 1* president?
i ceaaed to be president well on to a
year ago.
At a meeting of the company
Yes. 1 areigned my position at that
time.
Did you resign at a meeting?
1 presented toy re.ignatrun at a
westing of the pany.
Where was the meeting held?
In Mt. Smoke's otll'r,
That teas the late Mr. Smoke:-
Yee.
moke}Yes.
Who Was appointed in poor piece ?
No nae at that meeting, std 1 have
attended no meeting. ,ince.
Mr. Smoke we. solicitor for the
company?
He was vice -president of the com-
pany.
And his firm were the solicitors for
the company :' ,
His firm were solicitors for thecom-
pany-.
Was your resignatidn accepted i
Yes.
Who was present at the areetiug ?
Mr. Smoke and myself.
J u.t the two of you ?
Yes,
Did you still remain a director?
No, 1 resigned absolutely.
1 wnukllike you to tell me where
the minute book of the Ontario Went
Shore Railway Company is:
1 cannot tell you.
Where are the other pnpet•s belong-
ing to the company ?
I handed .11 the teller papers over.
To whout?
I sent, rheni over to the vice-presi-
dent's oilier.
What books did cosi seed over to
the vice-president?
There were the books of the com-
pany itself -business looks: they
were nut large : they caete thin, show-
ing the various recollections of the
company itself. and there were the
papers and things incidental to the
operations and business of the couu-
pany•
Do you mean to *ay that every scrap
of paper or hook that you had belong-
ing to the company- mss handed to Mr.
Smoke?
Yrs, they were sent over.
Can you tell we when these papers
were rent to Mr. Smnk-
They were sent over very shortly
after I tendered 'sty resignation, and
severed my cut:nection.
Did you actually "enol thou titre'
yourself ?
Yes.
Moyes story under oath was that he
had resigned the presidency of the
c nnpany gloat a year before. and
shortly afterward+ had handed over
alt the company s rook.: and paper. to
'Ir. Smoke: the vice-president, Mr.
Smoke was then dead. heaving died un
the _1.t of May. 1913. A welch
amongst the tatter's effects 11 his
bolsterer partners, and by his executor
tatted to disclose ,toy of the company's
looks and papers beyond the minutes
of meetings of shareholders and du ee-
tnrs. These latter which covered only
a few smooth, of the year bee were
eoneey;,ned only with the formal legal
nrganizstion of the company. Of the
hooks and papers w hich ,ecoided and
evidenced the transactions of the
pony, which retreated ours several
years, and involved the disbursement
of upwards of $1111,,111), no trace was
to be found. The hoard's enquiry hes
been piloted into this cul-de-sac byy--
Mayes, and there no doubt be intend-
ed it should end. And yet as &fter-
warl. appeared, thea story so swesawww
ly afftrosSilari8 reaffirmed 'hy Mnyrs,
was en infamous fahrication, head
men tell no talcs : and appreciating
this, with shameless cynicism and cal-
nulating running, Moyes sought to un-
load upon the dead vice-preeidcnt, Mr.
smoke, the vanished hooks and papers,
with all :he odium attaching to their
d iaa ppearance•
About the middle of January- last
Ow board learned that a trunk and
parcel of papers. probably rteIevant to
this 'inquiry, had came into Inc hands
of the city police. Their capture war
in virtue of the execution of a search
warrant hewed at the instance of John
W. MoyM against one William M.
Beater, residing at JOl Beverley street,
Toronto, in whose possession on these
premises they were band. An inspec-
tion ehowed that (bey rnntained the
long *ought books end ,papers, and
they were et once turned over to the
board, and Mr. A. C. Neff, a chartered
accountant., was appointed to examine
and report upon them. This Mr. Neff
has done In s thornngb and exhawtive
manner, and his report, afterwards
confirmed and amplified by bis sworn
testimony, is in the hands of the par-
ties to this application. Mr. Nefrs
labors were made more difficult by the
rendition of slain which a litoit-
