One Judge Dissents.
Toronto, Dec. O. —Two 'judges or a
Divisional t;ourt agree in dismissing the
appeal of Martin Ryan and his wife,
Margaret, of McKillop township,
Huron county, from the decision of
Mr. Justice Britton after the trial
at Uoderich last June, dismissiug their
damage aclam' against Ernest McIn-
tosh and George Stewart \Iclntuth.
The circumstance's are that Helmet
McIntosh was driving to Stestorth
with a load of hay weighing about Ai
cwt. His team were considered to be
usually quiet hotter, one about nine
years old, the, other about five. At
one place uD tharoad be became aware
that his load h d shifted to the right
side, the box rewaiuing on the wag-
on. He climbed down from the load,
and, leaving the reins lying on the
ground, posited around to the rear of
the wagon, and, geeing the only
thing to do was to loosen the binder
and tet the whole load go oil, called a
buy to help him loosen for chain.
When the load fell, either some hay
falling on the homes, or the chain rat-
tling, or the noise of the load failing,
or sutnetbiog else connected with u,
startled the borses, and as the driver
would have bad to torso around the

the plaintiffs, who had panned shortly
before that. causing Mrs. Ityan'a arm
