Tlie trial of the Heamishes for the
killing of %Vas. Mane' lasted four days,
and attracted much attention. The case

The first witness, John Matas, son of

openly for a couple of days preciously,
and the fathers stopped when they drew
near each other and Mr. Heamish asked

according to the evidence of John Mains

down and doing the principal part of the
aluggint'. When they left Mr. Mains
was bsaly kicked and bruised and in an
almost insensible condition, and he died
at ten o clock that night, though two
doctors were itt constant attendance.

After death a post•mortew elimination

ed artery. The Crown claims that the
artery was ruptured during the tight;
that the Beainishss knew that the three
Mains would pass that way that nu,rn-
iug ; that the elube urought to the place
hy the younger son were wade eap,e�ssly
fur the purpose of injutinil the Mains,
and that the Beamishea had Aside fre-
quent threats to kill old Mr. Mains a day
or two precious. The Heamishes were
arrai&nee. and pleaded not gailty to the
Lnarge. They were defended by B. B.
(filer, Q.C., of Ton,uto,and Mr. ()arrow,
of Goderich, Mr. fount, Q. C. , of Barrie,
conducted the case for the crown. Mr.
Osler submitted the first witness to a
long and tedium' cross-examination this
afternoon, but failed t( break down hu
evidence in any important particular. It
was late when his caaInuation was con-
cluded, and the court immediately ad-
journed. During the trial the three
prisoners were very much agitated.
Mr. Beamtab in particular being unable
10 control his face or his feelings, and
watched the proceedings s with the closest
interest.
The jury were hocked up for the night.

turned and rushed at Henry James. That
they clenched and had a tussle. after
which the other got into what might be

His address was lengthy, going; errer the
evidence in detail. At G 30 the court
adjourned until Monday morning.

The trial tires resumed on Friday morn-
ing and occupied the whole of the

of which was given in yeaterday's report.
The evidenca shuwe that the unfortunate
.occurrence was the result of a family
.quarrel, mut that the light between the
prisoner, Henry James, and the deceased
was the result d a challenge .n the part
of the decease1 which was taken up by
the prisoner. The evidence shows the
deceased to have lean a mac of violent
temper. The evidence by some of the
*keens', gis en on the part o1 the
crown, was somewhat weakened by cries-
, which elicited the fact
that they entertain a feeling of hostility
towards the prisoners, and left it open to
the defence to urge that they had given
a one-side:I account of the quarrel.
This view was strengthened hy the fact
that in a great many instance' the wit -
i ewes gave .much stmnver evidence
against the ,,rtsooers in the prevent trill
than they did betore the coroner'. jury.

the night.

court on Taturdey morning and
occupied the whole day. The defence

actual facts aupear to be as follows: --
A quarrel occured on Sunday, the 25th
of a
May, between 11 'm. Mains. the de-
ceased. and the prisoner, Thomas Man-
asseh Beainish : Thomas got rather the
worst of it on that .occasion and went
home and informed his bn,thcr Henry of
what had happened. Henry and Thomas
went dawn the road to nearly oppp(site

his hand. He was followed by his son
George, who alae had a stick. Mr.
Mains challenged Henry James Beamish
to tight. Henry replied that he would

ed that they should meet the next morn -

Mains suggested that they should meet
at 6:30 in the morning. Mr. Mains

arises. The Mains boys say that Henry

violent blow with his tist, and that in
this way the fight started. Willie
Beamish, a younger son of the
Iloamishes, says that when Henry James
came to where they were all upon the
mail, Mr. Mains urged his son John to
attack Henry : that his eon did nut seem
disposed to commence theafrey, where -
maim Mr. Mains became ionraged at his

and himself rushed at Roney, and that
in this way the tieht began.
The crown alleges that old Mr Bea
mish prevented any snterference on the
part of the Mains boys whale the fight
was going on between Henry and M.tins,
and that he struck Mains .over the head
with a stick.
Willie Beamish says his father did not
strike with a stick. The result ..f the
quarrel was that Mr. Mains died the
