C. , of Barrie, conducted the case for the crown. Mr. Osler submitted the first witness to a long and tedium' cross-examination this afternoon, but failed t( break down hu evidence in any important particular. It was late when his caaInuation was con- cluded, and the court immediately ad- journed. During the trial the three prisoners were very much agitated. Mr. Beamtab in particular being unable 10 control his face or his feelings, and watched the proceedings s with the closest interest. The jury were hocked up for the night. The evidenca shuwe that the unfortunate .occurrence was the result of a family .quarrel, mut that the light between the prisoner, Henry James, and the deceased was the result d a challenge .n the part of the decease1 which was taken up by the prisoner. The evidence shows the deceased to have lean a mac of violent temper. The evidence by some of the *keens', gis en on the part o1 the crown, was somewhat weakened by cries- , which elicited the fact that they entertain a feeling of hostility towards the prisoners, and left it open to the defence to urge that they had given a one-side:I account of the quarrel. Mains. the de- ceased. and the prisoner, Thomas Man- asseh Beainish : Thomas got rather the worst of it on that .occasion and went home and informed his bn,thcr Henry of what had happened.
