Huron’ County Judge Fran cis Carter has ruled that a person cannot be charged with refusing to take a breathalyser test unless police first define whether he is taking a roadside or breathalyser analysis test. The decision by Carter — to overrule a provincial court conviction against Carmen Allen Riley of RR1,' Londesboro, in an appeal hearing last month — is thought to be precedent setting. Carter, Crown Attorney Garry Hunter and defence lawyer Dan Murphy said Wednesday they don’t know of any other case in which a conviction for failing to take a breathalyser test has been overthrown because an of ficer failed to explain the difference in the tests. Carter said the breathalyser machine measures whether a person has more than the legal mimit of 0.08 milligrams of alcohol per 100 millilitres of blood in his bloodstream. He said the roadside machine “doesn’t give a reading at all, it just has to show you he has been drinking”. He said a person cannot be forced to take a breathalyser test unless the officer can show “resonable and probably cause” that the person has been drink ing. “All the officer said (to Riley) is, ‘I want you to take a breath test’,” and failed to distinguish between the tests, giving Riley reason to refuse. Carter explained the road side test can provide the “probable cause” an officer needs to ask a person to take a breathalyser test. LUII.
