Ferguson, Q.C. at the Court Room of The Mining and Lands Commission, 5th floor, Mowat Block, Queen's Park, Toronto, Ontario on the 29th day of November, 1977 at 10:00 in the forenoon to hear representations of all persons having direct interests as to whether the proposed refusal of the application of the Corporation of the Township of Hay dated the 25th day of July, 1977, under The Lakes and Rivers Improvement Act for approval of the location of a dam on Black Creek on Lots 19 and 20 in Concessions 4 and 5 of the Township of Hay, in the County of Huron is fair, sound and reasonably necessary for the achievement of the purpose of the said Act; AND FURTHER TAKE NOTICE that the Minister of Natural Resources will rely on the following grounds in sup- port of his proposed refusal: 1) THAT the proposed water course alteration would remove cover, destroy spawning beds and deteriorate water quality harmful to the fish populations native to and dependent upon the Black Creek. 2) THAT flooding 1Sroblems present on Lots 19 and 20 of Concessions 4 and 5 are a result of the soil type and presence of nuisance beaver. 3) THAT dredging and removal of all vegetation above the river bank will result in erosion and silting. 4) Such further and other grounds as the Minister may put forth and the Inquiry Officer may permit, AND FURTHER TAKE NOTICE that all documents, maps and plans that the Minister proposes to use at the hearing are available for inspection by parties to the hearing at the District Office of the Ministry of Natural Resources at Wingham, Ontario during regular office hours between Tues- day, November 15, 1977 and Monday, November 25, 1977. AND FURTHER TAKE NOTICE that any interested person wishing to attend and to make representation at the hearing must give notice of such intention to The Mining and Lands Commision, 5th floor, Mowat Block, Queen's Park, Toronto, Ontario' at least 2 days prior to the commencement of the hearing. AND FURTHER TAKE NOTICE that if you do not attend at the time and place aforesaid, the Inquiry Officer may proceed in your absence and you will not be entitled to any further notice in the proceedings.
