I read in your column two weeks ago, where someone
had received greeting cards in the mail which were not
ordered. My problem is quite similar in many respects,
because, in my mail recently, I received a credit card from a
department store which was certainly never authorized by
me, and because of this I simply threw it away and put it
out of my mind, but now the store is sending me bills
which claim that I have already charged some purchases
on this card.
I am worried in case someone has found this card and
used it.
Do I have to pay the bill?
It was my intention to visit their credit office in person
and give them a piece of my mind, but perhaps you can
save me the trouble and expense of an out of town trip.
By section 46 of the Consumer Protection Act, a person must
request or accept a credit card in writing or use it himself before
any action can be brought against him for money owing on the
credit card. A person receiving a credit card which he hasn't ask-
ed for has no obligation regarding its use or disposal.
We suggest that you send the store a letter, stating all the
facts and quoting section 46 of the Consumer Protection Act.
Hopefully this should save you the unwanted trip.

Your "IMPACT" column was able to help my sister with
a problem she had, some time ago, so I am hoping you can
do the same for me.
I live in a condominium apartment, but since I don't
drive or own a car I do not use the parking space allotted to
me. I also never use the swimming pool or squash court,
and what I need to know, is, if it is permissible for me to
sell my rights to these three "extras."
The reason that this has come up, is because I have a
friend who lives nearby and he has made me an offer to
purchase my rights to use all three.
I am quite willing to accept his offer, provided of course,
this is allowed, so that is the reason for this letter, to see if
it's alright for me to make money this way.
Would you be kind enough to advise at your earliest,
please.
After some enquiries, we must inform you that you may NOT
accept your friend's offer. S.7(5) of the Condominium Act, states
very definitely that, ownership of a unit, CANNOT be separated
from ownership of the common interest.
Sorry, but it's right there, in black and white!

My boyfriend told me to write your column about a
problem that is sure bothering the heck out of me, so here
goes!
He let me drive his car the other night, but I don't have a
driver's license and the trouble is, that we were involved in
an accident.
We had only gone about a block when a car went
through a red light and smashed into us. It was the other
car's fault, but since I was driving without a license would I
be considered automatically at fault? What will happen to
me now?
Just because you were driving without a license does not mean
that you'll be blamed for an accident that was obviously
someone else's fault.
You will, however, be charged under the Highway Traffic Act
for driving without a license. This will probably entail the imposi-
tion of a fine.
We hope that by now both of you have learned your lesson
and that you realize how stupid your actions were. It's very for-
tunate that the blame in this case, apparently lies with the other
party. It could just as easily have been the reverse, and then the
consequences would have been very very serious indeed!
