Rent legislation provides guidelines

hotel, motel or vacation home
which are rented for a seasonal or
temporary period not exceeding
four months, buildings first oc-
cupied as residential premises on
or after January 1, 1976, and
commercial premises,
Throughout Ontario the
Government is in the process of
establishing rent review offices
and officers in major centres,
which will handle disputes on
rent increases, and a rent review
board will hear appeals by
tenants and landlords against the
decisions of rent review'officers.
Under the terms of the Act, a
tenancy agreement gives or
renews the right of a tenant to
occupy a dwelling, and such an
agreement can be written, verbal
or implied. This means that even
without a written lease, people
are covered by the new
legislation. In the case of a
written agreement, the im-
portant date is that on which such
an agreement comes into effect,
rather than the date on which the
document is signed.
The rent review legislation is
tied to the dwelling on an annual
basis with the July 1975 rent
taken as the base rent. A tenancy
agreement entered into or
renewed and becoming effective
between July 30 and December
31, 1975, must reflect a maximum
rent increase not exceeding eight
percent of the rent charged
during the last full month prior to
August 1, 1975, unless tenant and
landlord have agreed on a higher
rate or the landlord has obtained
the necessary approval from a
rent review officer. If a landlord
applies to a rent review officer
for permission to increase rent by
more than 8 percent, a tenant
may file application with the
landlord requiring justification of
the increase. These applications
must be made by January 31,
1976.
If the proposed excessive
increase is mutually agreeable to
tenant and. landlord, then the
rental increase agreement must
be signed no later than January
17, both parties retaining copies.

The Agriculture and Canadian
Industrial group with Mrs. Bill
Berends convener was in charge
of the January meeting of Dash-
wood WI, Eleven members an-
swered the roll call "A beef I
have about our community which
could be used for a resolution."
Mrs. Ray Rader, president, dealt
with the business. Christmas
greetings were on display, in-
cluding one from Brother Bob
Mittleholtz which all the workers
at the centre had signed including
Adrianne VanRaay. The Institute
will sponsor four euchre parties,
2 in January and 2 in February.
The ladies were reminded that
Achievement Day for the 4-H
girls was January 24th. at
days after signature of such an
agreement in which to reconsider
and file application with the rent
review office. The agreement is
only effective for the rental
payment period ending
December 31, 1975. Either lan-
dlord or tenant can dispute the
increase by filing an application
or giving notice no later than
January 31, 1976. If they do not
agree on a rent increase above
the 8 percent guideline, or do not
apply to have the rent for that
period reviewed, the tenant is
Stephen Central School.
Mrs. Berends was chairlady for
the program. Mrs. Hilda Rader
discussed the motto, "It doesn't
do you any good to sit up and take
notice if you just keep on sitting,"

The ladies were divided into 3
groups and ideas for resolutions
were recorded and later
discussed. Senior citizens and a
nuclear power station in Huron
County .seemed to be the main
concern. Mrs. Berends brought
the program to a close with a
poem, "Today."
Miss Pearl Kraft has received
word that her sister-in-law
passed away in Grand Forks,
North Dakota. She was the for-
mer Naomi Kearcher widow of
the late Jacob Kraft who died in
1940. Mrs. Kraft who was 91 is
survived by a daughter, Grace
Kraft,
Mrs. Glen Rader and Mrs.
Wilmer Desjardine are patients
in Victoria Hospital, London.
An auction sale for Mrs.
Adeline Kraft and Lambert
Witmer was held at the com-
munity centre Saturday af-
ternoon with an overflow crowd.
Everything went like hot cakes
even old calendars and
catalogues. Mr. & Mrs. Emil
Becker have purchased the home
of Mrs, Kraft as she is a resident
of Queensway Nursing Home,
Hensall.
Mr. & Mrs. Fred Miller and
girls, Zion, were Sunday guests
with Mr. & Mrs. Dave Rader and
Stacey.

Joseph's Hospital, London,
Mrs, Lorne Becker is a patient
in St. Joseph's Hospital, London.
A woman who was seeking free
advice asked a farmer, "What
would be good to plant in a spot
that gets very little rain due to
overhanging eaves, has too much
late afternoon sun, has clay soil,
and is on a rocky ledge?"
"Lady," the farmer answered,
"how about a nice flagpole?"
entitled to a rebate of any rent
paid in excess of percent by
February 16, 1976, and if the
landlord fails to make this
rebate, the tenant ma apply to a
rent review officer for an order
requiring payment.
If a tenancy agreement is ef-
fective or renewed between
January 1 and July 31f, 1976, in-
clusive, the 8 percent increase
limit must be observed, ,but
landlord or tenant can request a
review. A landlord seeking an
increase of more than 8 percent
must file application with the
rent review office and inform the
tenant of his intention at least 60
days before the increase is
scheduled to go into effect. Until
such time as a review' officer
makes a decision, the tenant pays
a rent increase of up to 8 percent
over the last month prior to
August 1, 1975, A tenant wishing
to dispute a proposed increase
must, within 60 days of being told
of the landlord's intention, file an
application with the landlord
requiring him to justify the in-
crease, and a landlord may seek
a rent increase greater than the
one he originally sought when a
tenant disputes an increase, but
must justify this on the basis of
increased costs. Either party
may appeal the decision of the
rent review officer to the
Residential Premises Rent
Review Board, provided they
attend or are represented at a
rent review officer's hearing,
For tenancy agreements
becoming effective on or before
February 29, the parties must file
applications no later than
January 31. Within 15 days of
receiving notice, a landlord must
either reduce rent or file ap-
plication that he intends to justify
the planned increase. If a lan-
dlord does not reduce rent and
does not file application of in-
tention to justify the increase
during this 15-day period, a
tenant may apply to the rent
review office to have the increase
declared null and void. Rent
review officers will schedule
hearings and inform landlord and
tenant involved. Any rent review
officer's decision may be ap-
pealed by either landlord or
tenant to the Rent Review Board,
providing they or their
representatives attended the
review officer's hearing.
Application for appeal must be
filed with the Board within 15
days of the review officer's
decision.

One major piece of legislation
passed by the first session of the
30th Legislature was The
Residential Premises Rent
Review Act, 1975, This Act is
retroactive to July 29, 1975, to the
extent necessary to give full force
and effect to its provisions on,
from and after that date, and to
be repealed on the 1st August,
1977.
The majority of landlords and
tenants in Ontario cone under this
legislation, which covers all
apartments, houses, townhouses,
duplexes and triplexes, rooming
houses, mobile-home sites and
rent- gea red -to-inc ome units.
Exempt from the legislation are
certain non-profit housing or non-
profit co-operatives, units in a

the ministry of housing for an
Ontario Home Renewal Program
grant of $31,528 for the fiscal year
ending March 31.
This was decided at the
January meeting of Usborne
council held in Elimville January
7.
The motion was made by
councillor J. Stewart and
seconded by councillor W.
Morley.
The township will also adopt
the residential standards of the
Ontario Home Renewal program
guide.
In other township business the
reeve, deputy reeve and coun-
cillors discussed the heavy
agenda encountered during the
past year. Council is looking
ahead to the completion of the
sanitary landfill site in 1976. One
of the major problems faced by
the council this year is keeping
their spending within the im-
plications or the restraints of the
ppwincial and federal govern-
ment.
