For eight months now I have lived in an apartment
building which I like very much, however, the landlord is
something else again and I just cannot get along with him
no matter how hard I try.
His latest "piece of nonsense" is that he refuses to get
the elevator in the apartment building repaired, he gives
no reason for this stupid decision and I have no idea what
''' the rest of the tenants intend to do about this, but per-
sonally I intend to withhold my rent until he does get if fix-
ed.
Is there any law or reason why I should not?
Sometime ago you could possibly have got away with this
course of action, because this used to be a favourite tactic of
tenants to get what they wanted.
However, the present law is that a tenant may never withhold
his rent, even if the landlord is not fulfilling his part of the agree-
ment. Your remedy is to sue the landlord for breach of covenant
to repair. He also has a statutory duty to repair and you may sue
him on this and pay the rent into court.
If you simply withhold it, the landlord has valid grounds to
terminate your lease before the end of its term and to sue you for
rent due.

When a person enters an arena or some similar sports area,
gives rise to an old principle of law which says that where a
voluntarily consents to exposing himself to a possible in-
(ie. takes a risk), he accepts the liability if injury does occur.
In short, if you know something is dangerous and you do it
anyway, you are taken to accept the damage which may result.
Your children are taken to accept the ordinary risks of going
an arena (ie. flying pucks) but not the unordinary risks which
one could not reasonably see as being at all likely at a game (ie.
a player throwing his stick into the stands.)

My wife and I read and enjoy your "IMPACT" column
every week and this is the first occasion that I have had to
write you but, I had a friendly discussion with some
neighbours recently regarding house fires, however, since
nothing was actually resolved, we would appreciate your
opinion to this question.
What happens where someone's house catches fire and
the fire spreads and destroys other peoples property? I
maintain that the owner of the place where the fire
originated is responsible for all damages, and that a man
could be ruined for life if a couple of houses besides his.
own burned down.
Am I right or wrong?
As a property owner we are happy to inform you that you
would LOSE the argument, because in the case of an accidental
lire, the law gives you protection for just this situation as On-
tario's Accidental fires Act declares that no one can be sued for
property destroyed as a result of an accidental fire which starts
on his property.
The act applies only to property owners, and not to tenants.
Let us try and solve your problem for you ...
We can't solve them all but we promise that each
one will be considered.
