Deck, superintendent CN police. "Because of the noise a snowmobile makes and because most drivers wear well-insulated helmets, it is almost impossible to hear an approaching train, even when its whistle is blowing," he'says. McDOWELL prosecuted. Fines ranged from $5 to $100 depending on the cir- cumstances. The amended Railway Act clearly stipulates that the practice is illegal. Section 359 states: "Every person who, without authority therefor from the company, operates a vehicle upon the yard or right-of-way of the company, except where same is laid across or along a highway, is liable on summary conviction to a penalty not exceeding $100." Mr. Deck says CN intends to maintain strict surveillance of its tracks again this year and will continue to apprehend and prosecute snowrnobilers who travel across tracks or along its right-of-way. Despite warnings and a sur- veillance program last year, at least three people were killed when their snowmobiles were struck by trains. Several more were injured. This winter, CN will continue its efforts to educate snowmobilers, and the company is distributing safety posters to the news media, police depart- ments and snowmobile groups across the country. An Exeter man was fined $75 after pleading guilty to possession of a restricted drug in a special court sitting in Exeter, Friday. John F. Warkinton appeared before Judge Glenn Hays in one of two cases heard. Warkinton had been charged after a car was stopped by police on September 30 in Stephen Township. A packet of two pills was found in a jacket and sent to Toronto for analysis. The drug was identified as N.D.A., which Judge Hays said was termed a "hard drug". Aeronautical Engineering Branch and served at .Clinton, London, Trenton, Centralia, Winnipeg, Ramore, La Macaza, Germany and again .Clinton, He was the last .cornmoding ()Meer pf the Canadian Forces Radar and Communications School at Clinton and was the reviewing officer for the final graduation told the court the offence oc- curred four months ago and that he had not touched any drugs since and he was working. Solicitor P.L. Raymond also explained that the accused had changed his mode of living and suggested probation as the court's decision. Judge Hays said the penalty should serve as a deterrent, although he added he was im- pressed by the change in the life style of the accused.
