The 20th annual Morenz
reunion was held in Mitchell
Town Hall, Sunday with around
60 in attendance.

Your recent editorial enquired
why the Crown Attorney with-
drew two impaired . driving
charges, and accepted, in lieu,
guilty please on careless driving.
I acted for both accused and this
letter is written with their per-
mission.
Consideration of three separate
charges is involved — impaired,
breathalizer and careless. Only
the latter does not carry a
compulsory driving suspension.
Both accused Emmerton and
Boyd, faced dual charges of
impaired and blowing over .08 on
the breathalizer. Neither was
Clerk Earl Campbell reported
to Hensall council Monday night
that $61,399.15 of the year's taxes
has already been paid. This is
more than half of the total
amount and is the first time,
Hensall residents have had the
opportunity of paying their taxes
in two installments. Mr. Camp-
bell said he felt the majority of
people were well satisfied with
the system.
The clerk's mid-term report
showed the village's receipts
were $49,657. The expenditures
were $53,486 which included the
school levies to the Huron County
Board of Education of $28,202.50,
and $324.15 to the Separate School
Board.
A discussion on the cost of
nursing home care ensued when
it was brought to council's at-
tention that a local nursing home
had increased its rates to $11.00
per day. Members discussed
having its indigent citizens cared
for at Huronview. It was decided
to lay the matter over until it
could be taken up at the next
County Council meeting.
The Parks Committee reported
the men hired through the work
incentive plan had finished their
labor in the park. "The park
looks pretty good, now," said
Councillor Murray Baker. He
of Detroit visited friends and
relatives in this area on the
weekend.
Mr. & Mrs. Les Adams, Mr. &
Mrs. Harry Chapman, Mr. &
Mrs. H. Morenz attended the
Morenz reunion at Mitchell,
Sunday.
Mr. & Mrs. Jack Bazeley and
girls of Sarnia visited recently
with Mr, & Mrs. H. Morena,
originally charged with careless.
On a thorough examination of
the evidence in each case, it was
apparent each had an excellent
prospect of acquittal on the
impaired charge. Space does not
permit recitation here, but there
were in each case, at least 24
salient points indicating this
conclusion. These points are on
record and can be made
available to you on request.
Regarding the breathalizer
charge, the Criminal Code
provides for proof of the
breathalizer reading by filing a
certificate, provided proper
advance notice is served on the
accused.
In Boyd's case the police
electect to prove by certificate,
but served a defective notice,
referring to charges of impaired
driving only. They served no
added, however, that the brush
was starting to grow again
and that brush kill should be
sprayed in some areas. His
brother, Reeve John Baker,
replied, "The Parks board had
better smarten up. It's not up to
us to keep the weeds down in the
park."
The dump came under
discussion when Councillor
Harold Knight said that the mill
dump had caught on fire and was
blazing. "I hope tonight's rain
will put it out", he stated.
The clerk said Boise Cascade
are asking for an agreement
regarding their responsibilities
regarding the dump. Council
agreed conditions are not ideal at
the dumping ground but that the
best thing was to carry on until
something evolves regarding
area dumps under the provincial
jurisdiction.
Ernie Davis reported repairing
sidewalks and boulevards,
cutting weeds and grass and
cleaning up along the west side of
tracks. Council suggested he
line up a helper to assist him in
Patching the streets.
Mr. Davis informed the council

Council approved permits to

council accepted the tender of

sidewalks at a cost of $2.00 per
foot, The only other tender was
from McCann Construction at
$2.32 per font.

provides that the breathalizer
test must be taken within 2 hours
of the alleged offence, In
Emmerton's case the Police
followed the invariable Ontario
procedure,of 2 separate blows to
insure accuracy of machine
readings, and this was not
completed until 2 hours and 3
minutes after the occurrence.
Again, this charge must fail.
In both cases I discussed with
the accused, their probable
chances of dual acquittals, Boyd
was a career driver by profession
in the Armed Forces. Emmerton
was a heavy equipment operator,
with 20 years experience. Each
required his driving licence in his
profession. Each elected not to
gamble but rather to offer guilty
please to careless driving if the
Prosecution would lay such
charges.
The Crown, on having these
matters brought to his attention,
accepted the guilty pleas on
careless, and the impaired and
breathalizer charges were with-
drawn.
The same situation occurred
the following day, June 9th, in the
Wingham Court. Acting for Alan
Caldwell, charged with impaired
and the breathalizer, I pointed
out to the Crown that the im-
paired would probably result in
an acquittal, and the breathalizer
charge was defective, in that the
notice served on the accused,
referred to the wrong section. I
offered a guilty plea on careless.
The Crown considered the
matter, refused the guilty plea
and decided to fight the impaired.
Following trial, the impaired
charge was dismissed, the
breathalizer charge could not be
proved because of the technical
difficulties. In consequence, the
accused succeeded on all
charges.
