The hotel claimed the strike was illegal because of an improper strike vote, but J. H. Brown QC, alternate chairman of the Labour Relations Board, dismissed the charge, because the act does not require a vote to precede a strike. Labour Relations Board registrar A. M. Brunskill said the company has also made application to seek the right to prosecute Local 448 Retail, Wholesale and Department Store Union, A.F.L.-C.I.O.-C.L.C. which represents the workers, for calling and authorizing the strike. A hearing has been scheduled May 29 in London. The workers went on strike, April 9, following two strike votes. The first, March 9, ended in a 3-3 tie. A week later the workers voted 4-2 to strike. Hotel owners Mr. and Mrs, Charles Karpas have taken the position that the strike is illegal because the workers have not been certified as a union by the board. The board certified the union November 14, 1968. Efforts to negotiate a contract have failed.
