at Westminster Hospital, told
the court he had been confined
to his. home four or five days
with the flu and that he also
was taking a type of tranquilizer
pill four times a day for a
nervous condition.

whiskey during the morning and
afternoon before being stopped

warm water and sugar as a
remedy for his bout of flu.
Weber stated he had followed

or four days prior to the inci-
dent.

Defense counsel Elmer Bell,
QC, Exeter, told the court We-
ber had undergone psychiatric
treatment shortly after the in-
cident and pointed out that this
coupled with his other disabili-
ties lacked the ingredients to
convince the court he was
drunk.
In handing down his sentence,
the magistrate said he was not
levelling as high a fine in rela-
tion to Weber's impairment as
he usually did.
After Weber reported he had
not had a drink since February
10, the magistrate told him that
if he continued to not drink and
could show a need for a car he
would be most happy to give a
favorable report so he could
et his license back in a shorter
term.
The magistrate also highly
commended the action of Crane
and Marchilton for "fulfilling
their duties as citizens in in-
forming the police".
Held in custody
David George Buck, 18, RC-
AF Clinton, was remanded in
custody until Thursday when he
will receive sentence in God-
erich after pleading guilty to
a charge of stealing a car in
Clinton on May 8,
PC D, M. Westover stated the
youth had admitted his part in
the theft and was a passenger
in the car when it went out of
control into the ditch north of
Exeter. The ear, owned by Em-
erson Edwards, Clinton, was a
complete wreck and a fence at
the Fina depot was also heav-
ily damaged with the total esti-
mate of the damages to the car
and the fence set at $1,250.00.
Buck told the court he and
his partner had been drinking
prior to stealing the car and
wrecking it.
Sgt. Harold Preston, of the
Clinton service police, reported
that officials at Clinton RCAF
were considering releasing the
pair from the service.
Dismiss charge
A charge of careless driving
was dismissed against William
Frederick Howe, RR 2 Centra-
ha, despite the fact the magis-
trate told him he thought he
was responsible for a three-car
collision near RCAF Centralia
on April 14.
Howe smashed into the rear-
end of a car driven by Mrs.
Aileen Gillant, Centralia, which
aunt, Dr. Henry, in Toronto on
Sunday.

The magistrate said he felt
Howe was driving much too
closely to the Gillant vehicle
and had failed to take evasive
action as soon as he should
have. "But not everyone who
drives in a faulty manner is
guilty of careless driving", the
magistrate said in dismissing
the charge.
"Civilly I think Mr. Howe is
completely answerable to the
damages", he added.

In the only other case heard,
Mrs. Evelyn Scott, RR 2 Mitch-
ell, was fined $15.00 and costs
after pleading guilty to a charge
of failing to yield the right of
way.
Mrs. Scott made a left hand
turn onto number four highway
from number 83 and hit a ve-
hicle driven by Russ Broderick,
Exeter, who was southbouud.
Damage in the accident was
estimated at $400.00.
