Wtber, Exeter, was fined 800.00 and .costs of 813,90 and had his driving. license sus- pe-nded for months when he appeared b e F o'r e Magistrate (teen Hays, QC`, on a charge of druntc driving in Exeter court Tuesday. magistrate reduced the etIa-rge to impaired delving and ternwd Weber "a man in unique condition" after evidence re- v6Aled he had been taking two tYpes of drugs to combat the flu and a nervous condition and that he was always slightly un- steady due to leg injuries re- ceived in France during the last war. "I feel some slight hesitation in registering a conviction due to these peculiar circum- stances , the magistrate stated, latint lw was absolutely wreck- lees ,in taking on responsibility We said lw felt Constable Lloyd Hodgins had laid a proper Charge. Weber was .charged after two •entralia airmen followed him t _Quell Exeter on January 8 and then notified police of the erratic driving of the accused. -.Allan Crane and J, A. March- Mon told the court they fol. lowed Weber from the north end of Exeter to Sanders street where he made a left hand turn off Main St. • crane stated the car was weaving badly over the curbs and snowbanks and had forced traffic off the road on at least three occasions on its trip thrOugh Exeter. .-Hodgins found the accused parked on Sanders street be- hind' another ear, his front bumper tight against the other vAtele , and hi. wheels spinning as she attempted to get out onto the road. As the constable ap- proached, Weber backed up six feet and went ahead again smashing into the other car, breeking both headlights on the W0e,, r car. Carried to station ft.er Weber failed to get out when asked by the officer, Hod- gins got into the car and drove it.,.beck to the parking lot be. hind_the police station and car- ried Weber into the building. —Weber, who is an out.patient at Westminster Hospital, told the court he had been confined to his. home four or five days with the flu and that he also was taking a type of tranquilizer pill four times a day for a nervous condition. Tie admitted that he had con- sumed about six ounces of whiskey during the morning and afternoon before being stopped Hodgins shortly before sup- per. He had taken the drinks with warm water and sugar as a remedy for his bout of flu. Weber stated he had followed the .'same procedure for three or four days prior to the inci- dent. In explaining his actions on However, the magistrate said lie would not allow such an ex- hibition and asked him to try and get some one to prove his dis- ability. Weber's wife is as brought from her home and reported he had been hit with shrapnel in the war and was receiving a 40 percent disability pension for his injuries. She said the injury affected her husband's walk when he was overtired, Defense counsel Elmer Bell, QC, Exeter, told the court We- ber had undergone psychiatric treatment shortly after the in- cident and pointed out that this coupled with his other disabili- ties lacked the ingredients to convince the court he was drunk. In handing down his sentence, the magistrate said he was not levelling as high a fine in rela- tion to Weber's impairment as he usually did. After Weber reported he had not had a drink since February 10, the magistrate told him that if he continued to not drink and could show a need for a car he would be most happy to give a favorable report so he could et his license back in a shorter term. The magistrate also highly commended the action of Crane and Marchilton for "fulfilling their duties as citizens in in- forming the police". Held in custody David George Buck, 18, RC- AF Clinton, was remanded in custody until Thursday when he will receive sentence in God- erich after pleading guilty to a charge of stealing a car in Clinton on May 8, PC D, M. Westover stated the youth had admitted his part in the theft and was a passenger in the car when it went out of control into the ditch north of Exeter. The ear, owned by Em- erson Edwards, Clinton, was a complete wreck and a fence at the Fina depot was also heav- ily damaged with the total esti- mate of the damages to the car and the fence set at $1,250.00. Buck told the court he and his partner had been drinking prior to stealing the car and wrecking it. Sgt. Harold Preston, of the Clinton service police, reported that officials at Clinton RCAF were considering releasing the pair from the service. Dismiss charge A charge of careless driving was dismissed against William Frederick Howe, RR 2 Centra- ha, despite the fact the magis- trate told him he thought he was responsible for a three-car collision near RCAF Centralia on April 14. Ferris was making a right hand turn into a parking lot 500 feet north of the station ent- rance when the mishap oe- cured. The magistrate said he felt Howe was driving much too closely to the Gillant vehicle and had failed to take evasive action as soon as he should have. "But not everyone who drives in a faulty manner is guilty of careless driving", the magistrate said in dismissing the charge. "Civilly I think Mr. Howe is completely answerable to the damages", he added. Howe was defended by D, T. Murphy, Goderich, Fine lady driver In the only other case heard, Mrs. Evelyn Scott, RR 2 Mitch- ell, was fined $15.00 and costs after pleading guilty to a charge of failing to yield the right of way. Mrs. Scott made a left hand turn onto number four highway from number 83 and hit a ve- hicle driven by Russ Broderick, Exeter, who was southbouud.
