MacTavish, a 31-year-old Lon­ don architect, told the jury he did not see the approaching car (Foster’s) come on to his side of the road but he stated he guided his own course between the white lines and the shoulder of the road. Rather than look into the lights of the oncoming car, he watched the. shoulder. A third car, although not in­ volved in the accident, figured prominently in the evidence, Mr. and Mrs. J. B. Russell, Goderich, had parked their vehicle in a laneway near the scene of the crash experiencing motor trou­ ble. Mr. Russell was in a farm home phoning a garage at the time of the crash; Mrs. Russell was alone in the car, which was parallel to the highway facing north. Mrs. Russ-.'i told the court she heard, a thump and then saw the MacTavish car go by her. She said the London car was in its own Hne when she saw it. MacTavish brought his car to a stop some 600 feet north of the Russell vehicle and came back j to the scene on foot.
