Attorney for the Crown, Mike Murdoch of Kitchener, said Matthew Small was stopped shortly after 2 a.m. Aug. 6, after police noticed the vehicle he was driving cross over the centre line twice. Murdoch said the accused exited the car and walked back to the cruiser. Officers noticed he appeared unsteady. Small asked if he had been stopped for speeding, and admitted he had consumed eight or nine beers. There was also an open bottle in the vehicle, Murdoch said. Breathalizer readings were 150 and 159 mg of alcohol in 100 ml of blood. Small was convicted of impaired driving in 2006. Judge R.G.E. Hunter sentenced him to 30 days to be served intermittently. He has lost his licence for two years. IMPAIRED Kimberley Tout of Wroxeter pled guilty to driving while impaired. Murdoch said that at 11:15 p.m. May 24 in Howick, police were looking for a vehicle because of citizens’ concerns. Tout was the driver, and when police spoke with her they noticed signs of impairment. “When she stepped out of the vehicle she stumbled, swayed and was unsteady on her feet,” said Murdoch. Breathalizer readings were 200 and 190 mg of alcohol in 100 ml of blood. She was fined $1,000 and has had her licence suspended for one year. Hunter gave her six months ot pay the fine. GUILTY PLEAS An RR2, Blyth man pled guilty to driving while impaired and to marijuana possession. Brad Warwick was driving a vehicle in North Huron at 1:45 a.m. May 17. Murdoch said police officers were approaching from the opposite direction and saw the accused enter into their lane. They followed him at 140 km an hour in a 90 km zone and saw the car weaving from the shoulder to the other lane. When the officers stopped him, they noticed that Warwick’s speech was slurred and his movements were “slow and deliberate”. Upon searching Warwick, the police found six grams of marijuana. Breathalizer readings were 184 and 186 mg of alcohol in 100 ml of blood. Hunter fined him $750 on the drunk driving charge and $250 for possession. Warwick has six months to pay the fine. His licence was suspended for one year. THEFT A Wingham man received a conditional discharge and 12 months probation for theft under $5,000. Andrew Elliott pled guilty to the charge. Murdoch said at 7 a.m. July 6 a Morris-Turnberry resident saw his neighbour’s tractor being driven down the road. Believing the neighbur wouldn’t have been at the house at this time, the man became suspicious. The neighbour followed the tractor to where the driver met up with two men parked at the side of the road. The neighbour provided police with a description of the drivers of the vehicle and the tractor. Murdoch said the officer believed he knew who the driver of the vehicle was and took the neighbour to identify him. When they arrived two men were in the driveway of the residence. The neighbour pointed out Elliott as the driver of the tractor. SUSPENDED SENTENCE An altercation at F.E. Madill Secondary School resulted in a charge of assault against one young man. Wyatt Batte pled guilty to the charge. Murdoch said the fight occurred at 4:45 p.m. outside the school on June 9. Batte punched the victim twice in the head. Batte received a suspended sentence and 12 months probation. He is prohibited from owning weapons for five years. Lucknow man gets jail “It averages out so that if you go out drinking and driving 485 times, you’ll get caught once. With the Ontario RAID initiative we can make it so if a person drinks and drives once, the person will get caught once,” said Doug Abernethy founder of Ontario RAID. The Ontario RAID (Report All Impaired Drivers) program is an initiative that encourages the public to report suspected impaired drivers by calling 9-1-1 or (*) OPP 677 on their cell phone. “Calling and reporting suspected impaired drivers is an effective way all citizens can help the police and make their community safe by helping to get impaired drivers off the road before anyone is killed or injured,” said Abernethy. “I urge citizens, community groups and businesses to take an important step by contacting us to get involved by distributing RAID awareness material in their community which we will send them along with decals, wallet cards, posters and brochures. By communities getting involved in the RAID program, we will see reductions in impaired driving crashes, deaths and injuries.” RAID initiative increases chances of getting caught
