Thursday to charges of assault and to
careless use of a firearm.
The latter charges resulted
following a disagreement in
Wingham Sept. 24. According to the
attorney for the Crown, Clayton
Conlan, McGrail pushed the victim,
knocking him down. “He then
grabbed a BB air pistol which he
began waving around.”
The weapon discharged, said
Conlan, and the victim was hit in the
arm.
Defence counsel, Grant
MacKinnon, noted that “between the
push and the gun there was a
prolonged battle in which my client
was on the losing end.” McGrail
apparently ended up with a
dislocated shoulder and a black eye
as a result.
McGrail had already served 26
days before his most recent courtappearance, which MacKinnon feltwas punishment enough for hisclient. He told Judge R.G.E. Hunter,“They’ve been stacking them at the
jail, sometimes three to a cell. My
client is not the most forceful person
and as a result ended up sleeping on
the floor at times.”
Conlan, however, felt a longer
sentence was in order, highlighting
portions of the pre-sentence report
(PSR) in his argument. “To his credit
there are no prior assaults. But he
does seem to have a problem with
weapons.”
While the PSR is not the worst
he’s ever seen, he said, McGrail was
described as being unremorseful and
having a poor attitude towards
supervision.
“Twenty-six days in custody is not
enough in this case.”
MacKinnon said that to McGrail’s
credit he had been working to
initiate changes in his life. He also
said that his symptoms are not
aggressive, but re-active. “This is anindividual who can be helped.”On the guilty plea charges Huntersentenced McGrail to time served.For the earlier assault conviction he
received an additional 30 days to be
followed by 18 months probation.
McGrail is prohibted from owning
firearms for five years and is to
forfeit the air pistol.
He was ordered to provide a
sample of his DNA.
POSSESSION OF
A CONTROLLED SUBSTANCE
Chauncey Bolander of Fordwich
pled guilty to drug possession.
Conlan said police stopped a
vehicle in Fordwich on March 30.
Bolander was in the car, and
according to the Crown he reached
into his pocket and took out some
pills which he began to swallow. He
took three or four before police were
able to stop him. He had one
remaining.
The pills were prescription
painkillers for which Bolander did
not have a prescription. Conlan said the accused wasconvicted in 2006 of marijuanapossession. Defence attorney Tim Macdonald
told Hunter there was a joint
submission for a fine and probation.
He requested a fine in the range of
$250.
Hunter thought $400 was more in
order and gave the accused sixmonths to pay. Bolander is also onprobation for 12 months. FAIL TO APPEARPhilip Leger of Port Elgin pled
guilty to failing to appear for a Nov.
22 court date.
He has no similar record.
Hunter fined him $250, which is to
be paid in six months.

On March 20 at approximately 9
a.m. Huron OPP officers were
dispatched to a collision reported
through OnStar. The collision
occurred at the intersection of
Harriston Road and Gorrie Line in
Gorrie. Wingham firefighters and
paramedics were also dispatched
after calls were received reporting a
fire as a result of the collision.
The collision involved three
vehicles and was intersection
related. One driver suffered minimal
injuries and was treated at the scene.
A second driver sustained non-life-
threatening injuries, was transported
to Wingham Hospital and was later
released.
The third driver, Lisa Anderson,
32 of North Huron was pronounced
deceased at the scene.
A portion of Gorrie Line and
Harriston Road remained closed for
several hours as OPP Technical
Collision Investigators examined the
scene.
