Something fishy

Huron OPP say that many
motorists appear to be uncertain of
when they may legally pass a
vehicle on the right. There are only a
small number of exceptions that
allow this movement to take place
legally, said Const. Joanna Van
Mierlo.
Basically, it is not legal to
overtake and pass a vehicle on the
right side if the passing vehicle must
drive off the roadway, said Van
Mierlo. In layman’s terms, it is
illegal to drive onto the gravel
shoulder to pass on the right.
Exceptions to this law are for
police vehicles, ambulances and fire
department vehicles only.
The Highway Traffic Act speaks
to the times when passing may be
done on the right. They include if a
vehicle being overtaken is making or
about to make a left turn or its driver
has signalled his or her intention to
make a left turn. It also allows
passing on the right if there are two
or more lanes of traffic in the same
direction (multi-lane roads) or the
roadway is designated for one-way
traffic only.
Having said all this, if the passing
must be done by putting even one
tire onto the gravel shoulder, it is
illegal, said Van Mierlo.
“Just wait for the motorist ahead
to make their left turn before
continuing. The amount of time
saved by doing this dangerous and
illegal manoeuvre is not worth
it.”
