OPP remind parents about curfew lawWhile many youths are outenjoying the summer vacation asmall number are out causingtrouble, said OPP.Issues across the county that have been brought to the attention of thepolice include mischief such asspray painting, trespassing, LiquorLicence Act violations, thefts fromvehicles and others.It is because of this behaviour thatthe OPP are reminding youths,communities and most especiallyparents about the provincial curfew.Criminal behaviour by unsupervised teens that have parents who are areblissfully unaware of their locationor actions will not be tolerated, saidConst. Joanna Van Mierlo.In an effort to curb this type ofcriminal behaviour, the OPP arewarning teens and parents alike that they are authorized to enforce the Provincial Curfew stated in the Child and Family Services Act. The Act states that: between the hours of midnight and 6 a.m., if a child apparently or actually under 16 years of age is in a public place without a person over 18 years (authorized by parents) police may apprehend that child without warrant as a Child in Need of Protection.When a child is apprehended, theparents will be contacted and berequired to pick up the child.If it is alleged that they havecommitted a criminal offence, theywill be subject to criminal charges and subsequent consequences under the Youth Criminal Justice Act. “Parents, it is your responsibility to know where your children are at all times. If they report that they are staying with a friend, be sure that this is communicated between parents so that you know that to be the case. Your children are your responsibility,” said Van Mierlo. There are only a small number of exceptions that allow this movement to take place legally, said Const. Joanna Van Mierlo. Basically, it is not legal to overtake and pass a vehicle on the right side if the passing vehicle must drive off the roadway, said Van Mierlo. In layman’s terms, it is illegal to drive onto the gravel shoulder to pass on the right. Exceptions to this law are for police vehicles, ambulances and fire department vehicles only. The Highway Traffic Act speaks to the times when passing may be done on the right. They include if a vehicle being overtaken is making or about to make a left turn or its driver has signalled his or her intention to make a left turn. It also allows passing on the right if there are two or more lanes of traffic in the same direction (multi-lane roads) or the roadway is designated for one-way traffic only. Having said all this, if the passing must be done by putting even one tire onto the gravel shoulder, it is illegal, said Van Mierlo. “Just wait for the motorist ahead to make their left turn before continuing. The amount of time saved by doing this dangerous and illegal manoeuvre is not worth it.” Police clarify rules of passing on right
