Heather Foskett of Cambridge, formerly of Blyth, was convicted ofassault in Wingham court on June 17after entering a guilty plea on April22.Judge R.G.E. Hunter found
Foskett guilty and issued her a
conditional discharge with probation
and a five-year weapons prohibition.
The charges stemmed from an
incident on March 23 where Foskett
assaulted her stepdaughter in Blyth.
Crown William Kennedy said that
Foskett had been in a relationship
with the 15-year-old assault victim’s
father for six years before the
altercation took place.
Kennedy stated that Foskett was
intoxicated at the time of the
incident, having admitted to
consuming nine beers as well as
smoking crack cocaine earlier in the
evening.
The incident, which took place in
the kitchen, began when Foskett was
slurring a friend of the victim’s,
Kennedy said. When the victim
spoke up, standing up for her friend,
Foskett began to call the victim
names, insulting her and eventually
attacking her.
The altercation began with Foskett
throwing a beer at the victim, which
then escalated to her punching the
victim in the face, pulling her hair
and bending her thumb back.
While Duty Counsel William
MacKinnon said he felt the facts
were slightly exaggerated, they were
agreed upon.
Foskett asked that in addition to
the victim that the victim’s father be
added to the no contact list as a
condition of her probation, saying
that she was worried that he may
want to rekindle the relationship,
something Foskett said she does notwant to get involved with.PROPERTY DAMAGERyan Mawhinney of Brussels wasfined $1,000 after being convicted ofMischief under $5,000 in relation to
an incident which occurred in
Brussels on February 27.
The incident occurred shortly after
3:30 a.m. when Mawhinney entered
his home and began play-wrestling
with his stepson and his stepson’s
friend. Kennedy said the home,
which was shared by he and
Mawhinney’s wife, in addition to his
wife’s two children from a previous
marriage, was quiet when
Mawhinney returned from his
parents’ house after drinking all
night. She said he was intoxicated
and she asked him to leave and he
then became upset.
After his wife put him out,
Kennedy said, Mawhinney began
punching and kicking the door,
which his wife observed through the
peep hole in the door.
The door was damaged as a result
of the incident.
The relationship has since been
terminated, but because of a
previous disturbance complaint filed
between the couple in later 2009, the
fine was increased to reflect the
pattern that had been developed, said
defense counsel Mike Donnelly,
resulting in a $1,000 fine that
Mawhinney now has six months to
pay.
DAMAGE TO CAR
Dustin Miller pled guilty to
Mischief under $5,000 and Breach
of Probation stemming from an
incident on April 25, 2009.
He was found guilty on April 22,
but came back in June for his
sentence. The incident involved a girl thatboth Miller and the owner of the carhe damaged had been dating withina short time of one another, Kennedysaid.
Wingham Police received a call of
a loud banging noise from some of
the victim’s neighbours, which
resulted in the discovery of the
victim’s Mercury Grand Marquis
having its front and back windows
broken and three of its tires slashed.
Because the victim’s vehicle was
the only damaged car in the entire
parking lot, the police officer asked
the victim if he felt he may have
been targeted, which he said he did.
The police picked up Miller later
that night with a baseball bat
smudged with paint from the Grand
Marquis.
MacKinnon said that Miller had
been drinking and called his actions
“childish and inappropriate”.
Miller was order by Hunter to pay
a $1,000 fine in addition to the
restitution paid to the victim’s
insurance company in the amount of
$551.79 and $300 to the victim
himself.
Miller was given six months to
pay the fines, but he said he was
prepared to pay the restitution on
that day. Miller was also given 12
months probation and a no contact
order with the victim.
INCITING HATRED
William Hedger of Lucknow,
formerly of Ripley, was found guilty
of Inciting Hatred, stemming from
an incident on May 23, 2009.
Kennedy said police received a
call from neighbours that Hedger
and another man were standing on a
lawn in Wingham, yelling and trying
to get the home’s resident to comeoutside so they could fight.Hedger was said to have a baseballbat and several bottles of beer. Hewas also observed to be intoxicated,Kennedy said.
Hedger was yelling racial slurs at
the resident after making several
phone calls where he attempted to
challenge the victim to a fight in
order to “settle a score”.
Hedger was fined $750, which he
will have six months to pay, and
given 12 months probation.
FEAR OF INJURY
Tammy Ryan of Forwich was
found not guilty of Uttering Threats
after a trial in which three witnesses
testified against her.
The charges, which were laid by
Ken Schell of Fordwich alleged that
Ryan told him that “now that he’s
back, things are really going to start
happening” to him, as he had just
returned from a three-week vacation.
The original altercation between
the two stemmed from an incident in
which the defendant and
complainant’s children had become
involved in a fight, which spread totheir parents, resulting in a peacebond. However, since the peace bondhad been entered into, Schell said, things had happened like his house
being paintballed, his truck had been
set on fire and his son’s girlfriend’s
car had been vandalized, all of
which Schell attributed to Ryan, in
addition to some threatening
messages on the social networking
website Facebook.
Schell said that he was afraid to go
out of the house and that he had to
change his phone number due to
incidents with the accused.
He said that she had threatened
him, saying that she “knew a lot of
bikers” and that she “grew up on the
corner of Jane and Finch”.
Hunter, however, found no
sufficient proof that Ryan was
behind any of the vandalism Schell
accused her of, but did issue a stern
warning to both to stay away from
one another, saying that if they
should come in contact, one should
leave or call the police.

My Invitation to You
Are you confused ~ about Christ? Little wonder.
So many claim to speak for Him:who can you really trust?
So many opinions and theories surround Him:how can you know the
truth?
Here is my invitation to you.
For 42 years I have known the Lord Jesus as He really is: the Christ
revealed in the Holy Scriptures of the Old and New Testaments alone. For
26 years I have preached the Gospel truth - the orthodox Christian “faith
once delivered to the saints”, defined in the ancient creeds, and in the
confessions of the Protestant Reformers and martyrs. My message is
simple: authentic Biblical Christianity, whole, plain, pure, entire.
Many of you have never heard, never seriously considered authentic
Biblical Christianity. In a world of agnostic bishops, fallen priests,
political clergy, televangelist comedians, market-driven churches, ‘health
and wealth’ peddlars, prophetic prognosticators, faith-healing shamans
and door-knocking cultists, it is hard to find.
I am currently preaching in the Chapel
at Westfield Road and Marnoch Line
every Sunday morning at 11 am.
I am leading the people meeting there in a classic Protestant service - no
noise, no gimmicks, no frills.
I invite you to join me in the heartfelt, reverent worship of God Triune and
meet Christ Jesus as He really is through the pages of the Bible. My prayer
and heart’s desire for you, is that you should be saved.
This Sunday, come to Westfield. Get the Gospel truth.
Yours in the service of the Lord Jesus,
Rev. John Peter Bodner, M.A., M.Div.
