A Brussels man was given 12months probation and a $300 fine atWingham Court on Oct. 20 inconnection with an incident on Nov.
23, 2010 in Brussels.
Randall Struthers, who
represented himself when his case
was heard, said of that night “it was
something that happened that
shouldn’t have happened.”
Struthers was involved in a low-
speed head-on collision at a Brussels
address shortly after 6:30 p.m. on
Nov. 23 when he got out of the car
and grabbed the complaintant by
throat and pushed him away, said
Crown Attorney Chris Uwagboe.
Uwagboe said Struthers had been
charged with assault in 1997, but
there were no recent criminal
convictions.
Judge R.G.E. Hunter gave
Struthers four months to pay the fine
and also instituted a five-year
weapons prohibition on Struthers.
SAMPLE REFUSAL
Bradley Beuermann of Brussels
was given a $1,400 fine and a 12-
month driving prohibition for
refusing to provide a sample of his
breath on the night of June 9, 2011 in
Brussels.

OPP observed a vehicle being driven
by Beuermann leaving the Optimist
Ball Park in Brussels at
approximately 11:30 p.m. that night
when the officer observed thevehicle making “a jerky type ofmanoeuvre” Uwagboe said, as thevehicle turned onto Turnberry Street.
Uwagboe said Beuermann
continued to drive his vehicle to his
house, despite the officer activating
his emergency lights behind
Beuermann, signalling that the
officer wished for Beuermann to pull
the vehicle over.
Upon arriving at his home,
Uwagboe said, Beuermann
attempted to make his way into his
home, but the officer caught up with
him before he made his way inside.
Uwagboe said the officer noticed a
“strong odour of alcohol” on
Beuermann, in addition to “glassy,
bloodshot eyes”.
Uwagboe said Beuermann was
polite when he refused to provide the
officer a sample of his breath and
asked what the consequences were if
he were to refuse, to which the
officer explained and Beuermann
decided to not provide the officer
with a sample.
When asked if Beuermann had a
previous record, Uwagboe said
Beuermann had been fined $750 in
2000 for impaired driving.
Beuermann was given six months
to pay the $1,400 fine and if he
qualified for the Interlock program,
his 12-month driving prohibition
could be reduced to three months,
Hunter said.ASSAULTStephen Schneller pled guilty toassault on his sister stemming from
an incident on May 1, 2011 when
police were called just after 7 p.m.
Wingham Police officers were
dispatched to a home in Wingham
when they received a 911 call fromthe complaintant saying she hadbeen assaulted by her brother.Uwagboe said Schneller was
blocking his sister’s passage in the
home and when she tried to move
past him he shoved her. He said there
was “pushing and shoving” and then
Schneller choked his sister. Schneller said that while there waspushing and shoving, there was nochoking, to which Uwagboe agreed.
Schneller, who no longer lives
with his family, was given a
conditional discharge with 12
