Councillor Bernie Bailey,
according to his fellow council
members on North Huron Township
Council, has overstepped his
boundaries and, as a result, they
decided to restrict his ability to
comment about and to staff. “I feel
that we should limit councillor
Bailey s speaking to staff through
our chain of command until we
prepare and pass a bylaw code of
conduct for council,” Reeve Neil
Vincent stated. “Council must react
now, the statements that were made
could be construed as defamation...
or bullying.”
Deputy-Reeve David Riach
echoed Vincent’s statement, making
a motion using the above statement,
which was seconded by Councillor
Alma Conn.Vincent went on to state that thecode of conduct would be complete
with written sanctions for
inappropriate behaviour.
Bailey stated that he didn’t know
how this was legally possible.
“Honestly, I want to see the law
that gives Reeve Neil Vincent the
right to revoke my rights under the
Canadian Charter of Rights and
Freedoms,” Bailey said.
Bailey is referring to Section 2,
paragraph B of the Canadian Charter
of Rights and Freedoms which
guarantees “freedom of thought,
belief, opinion and expression”. The
Canadian Charter of Rights and
Freedoms is entrenched in The
Constitution of Canada and was the
first part the Constitution Act of
1982.
According to the act it is unlawful
to deny that right and remedies canbe sought for those whose rightshave been infringed upon or denied.
Bailey was also concerned that
this code of conduct bylaw, which
council has not yet directed staff to
draft or research, could affect his
ability to effectively represent his
constituents.
While no councillor would repeat
the statements made in open session,
they did, in their own comments,
state that it had to do with dealing
with staff.
Vincent explained, upon
questioning, that to limit the legal
ramifications of the situation, the
issue would be dealt with in-camera.
Councillor Ray Hallahan, who
didn’t make statements in support of
or against the motion throughout the
proceedings, wondered why the
issue wasn’t dealt with entirely in
closed session.“If we’re going to go in-camera todiscuss what was said, why aren’t
we in camera now when we’re
discussing the consequences,” he
asked.
Chief Administrative Officer Gary
Long answered, stating that, from
the corporate and staff side of the
township, a public statement would
be appreciated.
“Township staff would appreciate
a strong response from council,”
Long said before stating that the idea
to have this motion made was
Vincent’s. “It was the reeve’s idea to
discuss at least this part in open
session and I certainly appreciate it.”
Many councillors expressed
shock, disbelief and disgust at what
was said and apologized on behalf of
themselves and council for not
stepping in and stopping Bailey s
comments.Riach stated that, as the chair ofthe meeting, he feels somewhat
responsible for not reigning in
Bailey and that he apologizes to the
Recreation Department and his
fellow council members for not
“raising the gavel and stopping
Bailey as he was making his points”.
Councillor Brock Vodden stated it
was important to get the message out
to not only township staff, but to the
entire community, that council did
not support Bailey’s comments.

A massive stone chimney, deep eaves, gables and a double front door lend this two-storey family home an air of casual elegance that
