HEAT wants ‘firmer’ approach from council Discussion got heated when Huron East Against Turbines (HEAT) expressed its frustration with what members called Huron East Council’s “inaction” on the wind turbine front. The discussion surrounded HEAT’s meeting with Mayor Bernie MacLellan and two councillors, as well as legal information regarding turbine noise HEAT wanted to ensure council had access to. The discussion often involved raised voices and MacLellan had to employ his gavel on more than one occasion. Tom Melady, HEAT member, said he wanted to ensure that council had access to turbine noise studies conducted by top audiologists, specifically Rick James, a leading sound technician from Michigan who has worked with HEAT before. While council was concerned about costs that may be associated with such a sound study, HEAT members insisted that costs should be covered by the municipality’s forthcoming cost recovery bylaw. Before dealing with any specifics, however, MacLellan addressed a miscommunication between HEAT and council concerning council’s second legal opinion on potential turbine bylaws. MacLellan clarified what council had done for members of HEAT, saying that council did not go to a second lawyer to get a second opinion. When HEAT expressed concerns about potential bias in the municipality’s lawyer, councilauthorized bringing the first lawyer’swork to a second lawyer to confirm it was “good work” which he did. Council did not take its turbine information to a second lawyer who started on the issue from scratch, but rather had the first lawyer’s work reviewed by a second lawyer. HEAT member Gerry Ryan told council that the idea behind finding legal grounds to create a bylaw that deals with wind turbines was not to ask a lawyer if council could create such a bylaw, but to tell a lawyer that council wants a turbine bylaw,asking how that would be legallypossible. Ryan has often repeated that approach to council, feeling that a firmer approach would get work done, rather than falling back on legal precedent that shows such a bylaw can’t legally be created. HEAT member Jean Melady stated that the group’s issue with the municipality’s first lawyer was transparency, and that the group wants a noise study to be a part of a potential consultation form, which MacLellan said only makes sense. MacLellan says that the approvalprocess has a specific method ofmeasuring noise and if the province has adopted a sound study that HEAT members disagree with, there’s nothing Huron East Council can do about it. He said that he disagrees with it too, but if it’s the approved sound study method, MacLellan said, the province has the final say. Ryan was also concerned about council not moving to participate in a baseline sound study. A baseline study would examine current sound levels, so when turbines are erected,the new levels can be compared tothe pre-turbine levels to see how much noise has been added as a result of the turbines. “We’ve been requesting this since day one,” Ryan said of a baseline sound study. “You can do this, it shouldn’t cost you a thing.” MacLellan, however, explained to Ryan that the province has dictated the sound study process. “We have been told that this is the process whether we like it or BOB CUNNINGHAM Robert Lloyd Cunningham of Listowel and formerly of Ethel, passed away suddenly at Listowel Memorial Hospital on Monday, June 3, 2013. Bob was also loved by his many great-nieces and nephews, as well as great-great nieces and nephews. Bob was predeceased by his brother Ross Cunningham and sister Doris McDonald. Visitation was held at the Eaton Funeral Home, Listowel on June 7 with a Masonic Lodge Memorial Service held that evening. The funeral service was held in the funeral home chapel on Saturday. Interment was in Mount Pleasant Cemetery, Ethel. Memorial donations to the Heart and Stroke Foundation, Knox Presbyterian Church, Listowel or to a charity of one’s choice would be appreciated. She was 81. The former Anne Chamney was the beloved wife of the late Sam Thompson who predeceased her in 2004. She was the loving mother of John and Joyce Thompson, RR 2, Lucknow; Susan and Gordon Haggitt, Blyth; Murray and Doreen Thompson, RR 1, Belgrave; Ellen and Ron Huya, Buffalo, New York and Julie Thompson, London. Anne will be lovingly remembered by nine grandchildren and 11 great- grandchildren. She was predeceased by her parents Cecil and Beatrice Chamney and by her daughter Jane Bromley in 1999. Visitation was held at McBurney Funeral Home Ltd., Wingham on Thursday. The funeral service was held at the funeral home chapel on Friday, June 7. Pastor Elly Dow officiated. Interment is in Wingham Cemetery, Wingham.
