$5,000 in Wingham court on Feb. 21
after her grandfather reported his
2003 ATV stolen in August of 2012.
Crown Attorney Laura Grant said
that on Aug. 9, 2012, Minielly
travelled to her grandfather’s home
in Huron East and stole his ATV. The
next day, Grant said, Minielly sold
the ATV to Jeffery Darroch for $600,
which included ownership and
insurance documents.
Grant said that two days later the
ATV was recovered by police and
returned to Minielly’s grandfather.
Duty Counsel Lynn Johnston said
that while Minielly had been
convicted of driving with over 80
milligrams of alcohol in 100
millilitres of blood in 2010, she had
recently been taking steps to try and
turn her life around.
Johnston said that Minielly is
currently on Ontario Works and is
hoping to pursue her college
education in the near future.
Minielly’s long-term goal, Johnstonsaid, is to ultimately own and
operate her own business.
Judge R.G.E. Hunter placed her on
a 15-month term of probation and
ordered Minielly to pay restitution in
the amount of $600 to Darroch, who
was out the money he paid to buy the
ATV, which he thought he was
purchasing legally.
Johnston pleaded with Hunter,
saying that Minielly didn’t have the
means to pay, but Hunter said that
was “too bad” adding that Darroch
wanted his money back and that he
didn’t blame him.
Darroch, as well as Chauncey
Bolander, were both charged with
possession of stolen property, but as
a result of Minielly’s guilty plea,
charges against the two men were
withdrawn by the crown attorney.
FRAUD
Bradley Hiusser of Harriston
received jail time after pleading
guilty to one charge of fraud and one
charge of failing to comply with the
terms of his probation after over amonth of fraudulent transactions
made in North Huron.
Grant told Hunter that from Feb. 9,
2012 to March 16, 2012, Hiusser
had been attending an auto parts
dealer in Wingham and ordering car
parts under his father’s purchasing
account.
The charges came to light when
Hiusser’s father, Bradley Hiusser Sr.
reported to the Wingham Police
Station on Aug. 22, 2012 with a
statement from the auto supplier
listing all of the parts that had been
bought on his account which he had
never requested and had never
received. Hiusser Sr. told police that
he had a feeling with was his son
who had made the requests. His
son, Hiusser Sr. said, had previously
had access to the account, but
after the pair had a falling out, Grant
said, the two men decided to part
ways.
Johnston said that at the time the
two decided to divide themselves
professionally, Hiusser Sr. alsoterminated a lease with his son,
effectively putting him out on the
street. Hiusser, Johnston said, was
forced to fend for himself and to find
a new job he needed a working
vehicle and to get his vehicle
working, he needed several auto
parts, which is why he made the
fraudulent transactions.
Johnston said that in recent
months Hiusser had paid $700 down
on the total cost of the parts, which
was $2,115. Hiusser claimed that he
could pay the remainder of the
restitution in six months.
As Hiusser had just started a new
job, Johnston said, she was asking
for perhaps a large fine rather than
jail time, which is what Grant was
seeking. Grant told Hunter that she
was seeking a jail term of between
60 and 90 days.
Hunter sentenced Hiusser to 60
days in jail, 30 concurrent and a 12-
month period of probation, which
was to start that day.
ASSAULTRichard Rawn of North Huron
pled guilty to one charge of assault
stemming from an incident on Jan.
4.
Grant said that on Jan. 4 police
responded to a 911 hang-up in
Wingham where, it was later
discovered, Rawn was engaging in
an argument with his significant
other.
Grant said the argument began
over fidelity within the relationship
and escalated when Rawn grabbed
and pushed the woman he was
arguing with. Grant said the woman
grabbed the phone and attempted to
call 911 but Rawn wouldn’t let her
complete the call.
The struggle, Grant said, was
witnessed by the couple’s child, who
also called 911 in an attempt to stop
her parents from fighting.
Johnston said that since the
altercation, Rawn and the woman
are planning on giving their
