Despite a great deal of support,
Ashfield-Colborne-Wawanosh
(ACW) resident Shawn Drennan
was left without an answer after a
court date on Friday, March 1
regarding wind turbines near his
home.
On Friday, Drennan and his wife
Tricia attended court in Goderich to
respond to a motion made to have an
injunction he is pursuing stopped.
The injunction would see the
construction of wind turbines near
his property stopped until issues can
be re-examined.
Justice A. Duncan Grace presided
over the court session and held his
judgement in reserve until he could
reflect on the five hours of
discussion and the stacks of
documents that had been presented
as evidence both for and against the
injunction.
Originally, the injunction was
filed against K2 Wind Ontario Inc.,
K2 Wind Ontario Limited
Partnership, Director of the Ministry
of Environment Agatha Garcia
Wright and Her Majesty The Queen
in Right of Ontario, however Wright
was removed prior to the case as it
was felt naming an individual
wouldn’t reach the goal.
“We had moved to the Ministry of
the Environment,” Drennan
explained in an interview with The
Citizen after the court date. “There
are more people at the Ministry of
the Environment who can do the
[Renewable Energy Approvals]. We
want this to be more applicable to
the larger agency more than just the
specific person.”
Drennan felt that, despite the lack
of a decision, the day was good.
“I was happy with the day, we
were all happy with the day.” he
said. “I was very happy with the
judge. He was very engaged, asked
really tremendous questions but I’ve
never been to court, so maybe that’s
normal.”
Drennan pointed out that a lot of
new information was brought
forward and it will be interesting to
see what comes of the case.
The couple claims there could be
unknown maladies caused by the
wind turbines and that, before their
construction, those maladies should
be researched. Their claims,
however, were dismissed by both the
council for the Ministry of the
Environment and K2 Wind.
Hart Schwartz, speaking on behalf
of the Ministry of the Attorney
General, said the Drennans’ issue
should be dealt with through the
REA [Renewable Energy Approval]
process, however the Drennans had
already stated in their affidavit they
felt the REA was a “rubber

He said their claims were
