every precaution.
He explained that he was aware
that the pigs being delivered, five
animals ranging from 125 pounds to
250 pounds each, each had a hernia
between the size of a grapefruit and
a soccer ball, but none of them were
on the ground and he had separated
the animals to prevent them frombeing involved with altercationswith other animals. He waited until
the last minute to get them in for the
slaughter to prevent them from being
mistreated by any other animals in
slaughter run.
Unfortunately for Nyenhuis, by
waiting that long, he was arriving
while both a federal inspector and
provincial inspector were at the
plant. While the federal inspectorwas reasonable and talked throughNyenhuis’ situation with him,
resulting in no action being taken,
the provincial inspector had
Nyenhuis case written up and it
somehow made its way in to the
hands of the OSPCA after a deadbolt
had been used to execute the animals
and pictures had been taken.
Nyenhuis and his wife eventually
saw the pictures months later andwere shocked at the graphic natureof the pictures. He was charged with
causing the animals’ distress as well
as permitting them to be in distress
by the OSPCA, several days after the
incident at the butcher.
After months of legal proceedings,
Nyenhuis settled for a $750 fine plus
paying court fees. The final charge
was $889 plus $700 to $800 for his
own legal fees.
While that should have ended the
issue, the OSPCA representatives
stated that, if he was found in
violation of their act a second time,
the charge would be a minimum of
$25,000.
Nyenhuis explained that life is a
lot different on the farm now. He has
to euthanize any pig with a hernia
bigger than a tennis ball and, when
he looks at his family dog, which is
getting on in years, he sees another
risk.
“We always keep it outside, give it
food and water and it has a heat bulb
to keep it warm, but I realize we
probably should euthanize it,” he
said. “If the wrong person came in
and tried to take pictures to make it
look like a worst case scenario, it
could be the end of us.”
Nyenhuis said that the problem
facing farmers is that the OSPCA
has no accountability. It reports to no
governing body above themselves, is
able to set its own fines and
determine its penalties.
“I would like to see, to add
credibility, someone that the OSPCA
has to answer to and someone that
could receive calls and complaints
about the group,” he said. “Not all
the OSPCA inspectors are used to
modern agriculture and may not
realize what the realities are.”
After hearing Nyenhuis’ story,
another panel member, Dr. MartyMisener said that, had he beencalled, he would have said that
everything had been done properly.
He also said that he would have been
wrong in the eyes of the OSPCA.
“In my opinion as a vet, John is an
excellent farmer,” he said. “He and
his family place animal care and
welfare high on the priority list.”
He went on to say that,
unfortunately, times have changed
and even good farmers who care
about the condition of their animals
are running into these problems.
Other panelists included Kurtis
Andrews, a former farmer and
current lawyer, Carl Noble, a former
member of the board of the OSPCA,
MPP Jack MacLaren from Carleton-
Mississipi Mills and president of the
OLA, Tom Black.
The discussion that the group had,
focused on the OSPCA, indicated
that all thought that sweeping
change was necessary, both from the
legal documentation that supports
their existence and for their board.
Andrews went so far as to say that
the entire organization has been
corrupted and infiltrated by fanatical
animal rights extremists and groups
like People for the Ethical Treatment
of Animals (PETA) who are placing
the welfare of animals above that of
humans. He said that the board
needs to reflect the reality of Ontario
and have more representation from
the people who work with most of
the animals; farmers.
He also advised farmers that, if
they ever have the OSPCA’s agents
show up at their door, they should be
prepared to bring in witnesses.
“Get your vet involved with any
situation that occurs,” he said, later
adding that neighbours can be called
