and that Smith deserved the same
treatment.
Grant disagreed, however, saying
that she felt Smith deserved an
intermittent sentence for the crime
and that because he was a year older
than his two accomplices, it made
him an adult and therefore the
sentence should be more severe.
Hunter, however, said he was
prepared to impose an 18-month
probation term on Smith.
In addition to the probation term
and community service, Smith was
ordered to pay one-third of the
restitution for the damage to both
businesses, which came out to just
under $330. Smith was given three
months to pay.
Smith was also handed a $200 fine
for two unrelated charges of
possession of stolen property.
While Cornish said he and Huron
County Crown Attorney Teresa
Donnelly had discussed those two
charges being dropped, Grant told
him that was not the case.
Grant said that on May 25, 2012,
police were called to Smith’s house
by his mother, who had made the
call in an attempt to stop Smith from
driving that night.
Grant said the police were told
that Smith had been drinking that
night and was planning on driving.
Beyond the fact that he had been
drinking, Grant said that Smith was
bound by an order to be off the roads
until December, 2012.
When police arrived, Grant said,
they ran two licence plates in
Smith’s possession and found that
one belonged to a Brussels-area
plumber and the other belonged to a
Brussels-area business owner.
Grant said that once the true
owners of the plates had been
discovered, Smith admitted to
stealing them just hours earlier that
night. He also admitted to
consuming six beers that night,
Grant said. Smith pled guilty to the
two charges.
Grant suggested a fine of $150 on
each count for a total fine of $300.
Hunter, however, went slightly
lower, imposing a fine of $100 per
count for a total of $200.
Smith has six months to pay the
two possession of stolen property
fines.
BREAK AND ENTER
Donald Stephens of Listowel pled
guilty to two charges in association
with a break and enter on Aug. 10,
2012, landing him over six months
in jail.
Stephens’ lawyer and Grant
presented Hunter a joint submission
for Stephens’ incarceration, which
involved him pleading down on a
charge of breaking and entering.
Stephens pled not guilty to a
charge of break and enter, stemming
from an incident in Huron East on
Aug. 10, 2012. He pled guilty to one
charge of unlawfully being in a
dwelling home and to one charge of
breach of probation.
Grant said that on Aug. 10 a man
working at a nearby dairy farm
noticed two men riding their bikes
around someone’s home. The man,
knowing that the occupant of the
home had recently died, was
suspicious, said Grant.
The dairy farm worker noticed
Stephens coming out of the home
carrying several items. The pair then
took the items and rode away on
their bikes.
The witness followed the two of
them to a residence on Jamestown
Road and waited at the laneway
while he called the police.
When police arrived, Grant said,
the men were nowhere to be found,
so the canine unit was deployed and
the men were eventually found lying
in a nearby corn field.
Upon being questioned by police,
Grant said, Stephens said that a
woman who had lived in the home
had taken the items from him and he
was simply recovering them.
Stephens’ lawyer made the case
that on the charge of unlawfully
being in a dwelling Stephens
should serve six months in jail
minus the 20 days he has already
served in jail. (Stephens was arrested
that day and remained in custody for
nearly three weeks, his lawyer
said.)
Hunter sentenced Stephens to 160
days in jail on the charge of
unlawfully being in a dwelling and
an additional 30 days concurrent on
the breach of probation charge.
Stephens had broken a probation
order that had been made in
December, 2010.
Upon being released from jail,
Hunter imposed a 12-month
probation term on Stephens.
