Cue or more spiles that were
driven 'in by hand. From tree to,
tree They haceplastic pipes for all
the sap to ,run through and then
into a big metal , tub. This made
collecting the sap a lot easier, .
After we went through the
thtee hundred tree bush we got
back on the bus and travelled to
the Axtmann's house. There we
saw them boiling the sap.over an
open fire which Was • fueled by
wood. We watched the sap being
boiled into syrup and got a taste
d very sweet maple fudge. Then
we got all „ our questions
answered. Mrs. Axtmarni and the
other people who helped -her
answer our questions must have
had very' good tempers. After
everyone bearded the bus we
returned to the school and...the
wry next day we had the syrup
Mrs. Axtm ann. gave us over
vanilla ice cream.. What could be,
Lietter..way to eat it?!

Recently the grade 8B .pupils
preSented original stories to the
primary students. The stories
were read in groups which were
located in :•various places around
the school. Each - student wrote,
his own story and silent many •
hours illustrating. pictures. They
ranged from funny to mysterious.

got there we, travelled on foot
through the bush with several

accompanying us. Most of the

Question; I have heard that there
is a new Act which changes family
law in Ontario. Has there been
such an Act passed?
Answer: Yes. The new Act which
came into force March 31,1978, is.'
titled "An Act to reform the law
respecting property rights and '
support obligations • between
_tnarried persons- and, in other
family relations", It s a very
comprehensive piece of
legislation which revolutionizes
the,'area of family law.
Questions: How the new
Law Reform Act affect the
average person like myself, who
is married and owns house and a
car?
Answers:. The aim of the new Act
is to achieve a more equal division
of property and obligations to
provide support payments upon
the breakdown of a marriage.
Marriage is now treated .as a
partnership and there are certain
types of property that will be split
equally. These are known as
family assets. Family assets are
property owned by one or both of
the spouses which are used by the
family for shelter or— tran-
sportation or - for educational,
recreational, social or aesthetic

owned— sepa ately •during' the
marriage an each spouse can
deal with th m freelyexcept
certain restri ‘tions covering the
matrimonial ho e. It is onlyupon
marriage breadkdown that the
spouses are restricted in their
dealings with tinnily assets.
Question: My husband, who owns
a hardware store has run dff with
a go-go dancer, He has told me
that I can have a half interest in
'the hou se, but the business is all
his. Before we started to raise a
family I used to work in the store.
Am I entitled to any share in the
business assets?
Answer: You may. have a partial
interest 'in your husband's
business. The actual amount' will
depend upon your contribution,.
Where a spouse or former spouse
has given money, or worked so as
to help the other to. acquire,
Maintain, manage, operate or
improve a property other than
family assets, in which the other
has an interest, the court may
award either a payment in cash
for the interest, or a share of the
interest according to the con-
tribution of the spouse The court
will look at ' the aces without
regard to the relation of husband
wife and the fact that the acts
making up the contribution were-
those that would be expected of a
reasonable husband or wife in the
circumstances. Therefore your
work in aiding your husband may
qualify you for an interest.
Question: My wife and I are
thinking of buying a new home. If
the houseis ptkt in my name only,
- will my wife automatically be
given a. half interest in the house
as a result of the new Family Law
Reform AO?
Answer: The new Act restricts
dealing with a house, even if it is
the name of onespouse only, if it
is found to be 'a "matrimonial
home'-'.. T,lie matrimonial home is
a ' house used as a family
residence. During the marriage
neither spouse con sell. or
mortgage the home without the
other's consent regardless of
which spouse owns the house.
Upon marriage breakdown either
spouse may apply for a court
order for possession of the
matrimonial home. •
Finally, there • will be equal
division of family 'assets including
the matrimonial home where the
marriage is, legally ended or the
spouses are separated and there
is no reasonable prospect that the
spouses . will be living together ,
again. , This equal divisiee.....,..ef
family assets'will be made"
regardless of the ownership of the
assets by the spouses. Your wife
therefore will only be given a
.legal interest in one half of the,
house upon marriage breakdown,
but has other rights in the house
that are protected during the
marriage.
Question; After ten years of
marriage my husband has .left
me. We have two children age six
and eight. Can I get support for
myself and the children?
Answer: under the new Act every
'spouse has an obligation to
provide forihimself or herself and
for the other spouse, in Ac-
cordance with need, to the extent
'that he/she is capable of doing
so.
Upon application, a court may
order a person to provide support
for his or her dependents and set
the amount they will be required
to pay. ' •
The major changes in the law of
support are: (1.) Wives and
husbands, have an obligation to
' support themselves. (.) Wives
have an obligation to support
husbands. The obligation for'"
support is mutual. (3) Support
orders are made on the basi, k;i'
need and ability to pay.
The court will consider all f the
'circumstances when deter , fining
the amount of support incloding:
(1.)'Assest and means •oP the
person dependent upon sup nort
and the person who will be
requircu to pay support. (2.) The
ability of the person seeking,
support to provide for his/her
own support. (3.) Age and
physical and Mental health of the
persons involved. (4.) The ac-
customed standard of living when
- the spouses lived together.

• Question: Is it true that under this
new law children can be required
to support their parents?
Answer: Yes. The new law states
that every child who is over the
age of eighteen has an obligation
to provide support to their
parents, if theirs parents • have
cared for and ,provided support to
that child and if their parents
have need for support. The child
is obligecrto provide'support only
to the extent that he/she is
capable of 'so doing.
Question: My boyfriend and I are
considering marriage. Is it true
that we can draw up a contract? If
we do, what could it cover?
While 'they are still liv'
togethep. (2) Cohabitation
agreement - A man and a woman
who are cohabiting may 'enter into
an agreement in which they,agree
on their respective• rights and
bhligations, during cohabitation.
(3) Separation Agreement -,'- A'
husband and wife who have
separated may enter into an
agreement' outlining their• rights
and obligations.
Since you .and your boyfriend are
about to enter into marriage, you
would be considering a marriage
contract.
Under the new act Spouses can
make a marriage contract out-
lining obligations during roar-
Hoge or "upon separation or
annullment or dissolution of the
marriage or upon the death of one
of them,
This contract could deal with: (a)
Ownership in or division of
property. (b) Support obligations,
(c) The right to direct , the
education and moral training of
their children. (d) Any other
matter in 'the settlement of their
affairs. -
There are 'exceptions and limita-
don to the subjects spouses can
deal with in their Marriage
contract: (1') They cannot contract
regarding the right to Custody of
or access • to their children.
HoWever, they can contract about
matters in a 'separation agree-
ment, whiCh they would draw up
when they have to live together. •
(2) They cannot put provisions in
the marriage contract that at-
ternpts to limit the rights, of 'a
spouse regarding the matrimonial
honie; (3) Any provision in a
, marriage contract that deals with
children can be disregarded by
the court if the court feels it would'
be in the best interest of the child.
A marriage contract would also be
invalid if it was made under
duress, undue influence or fraud.
The contract must be in writing,
signe0y-kliepersonp to be bound
and witnessed.
Question; What will happen to. my '
husband if he. does not pay the
support the court has ordered?
Answer: Under the new act, the
Provincial court (Family Divisien)
Will .have power-to enforce ,
support orders, If there. Is a
default le payment a notice may
be issued requiring the person
who has not paid under the
support order, to appear- before ,
the court to . explain the default.
If he does not 'appear the court
may issue a warrant for. is arrest.
If the court feels that he has the
ability tepay but is not doing so,
the court may order imprison-
ment for a term not longer than •
three months or the court may,
make an attachment Order. This
order' would direct the employer
Of the ,person who has not paid
under . the support order, to
deduct the amount due. from his
wages and pay the amount into
court.
