Because a judge lost his notes, Martin Morrissey, represent-

exceptionally slowly during the his client was entitled to the
past eight years for Middlesex amount for dewatering, even

He said the contracting firth Despite the delay,, justice has
been done, Middlesex. County took "a calculated risk" when it
council has been'told, according agreed to dewater because this
to a story in .the London Free could have cost-much more than
Press. $3,815.
R.J. Flinn, representing the
county, said Wednesday that County court Judge T.). Jacob
said that during the move from
the old courthouse to the new one
he misplaced his notes of the
Octriber, 1968, civil. action
between the county and the firm.
.The judge finally found his
notes and in June this year
awarded a judgment of $4,283,
including interest ,of $386, to
Looby Builders, (Dublin) Ltd.
County council decided it won't
appeal the decision and
'authorized payment of the award,
although one councillor said he
doesn't, agree with the decision.
The Looby firm had sued the
county for $3,815 which the firm
claimed was still owing as part of
a contract for a bridge built on the
Delaware-Westminster townline
in 1966.
Looby claiine&the amount was
inclulied in its bid of $77,725 for
dewatering - removal of water to,
ensure dry concrete footings for
the bridge.
The county had refused to pay
the $3,815 because it said the firm
did not have to remove any water.
Judge Jacob ruled the firm was
entitled to interest (at six per cent
a year) of only $386 from May,
1967, when the writ was lsstied,
to April, 1969 - six months after
the action was heard.
The 50-foot bridge was built
over Dingman Creek, 11/2 miles
north of -Highway 2, as a private
entrance 'to a farm 'on the
townline. The contract also
included a stream diversion, road
fill and a gabion control darn.
