One major piece of legislation 'passed by the first session of the 30th Legislature was The Residential Premises RentReview Act, 197,5. This Act is retroactive to 29th July , 1975, to the extent necessary. to give full force and effect to its provisions on, from, and after that date, and to be repealed or! the 1st August, 1977. The majority of landlords and tenants in Ontario come under this legislation, which covers' all apartments, houses, townhouses, duplexes and triplexes, rooming houses, mobile-home sites and rent-geared-to-income units. Exempt from the legislation are certain non-profit housing or • nonprofit co-operatives, unit' in a hotel, motel or vacation home which are rented for a seasonal or temporary period not exceeding four months, buildings first occupied as residential premises on or after January 1st. 1976, and :ommercial premises. Throughout Ontario the 3overnment is in the process of establishing rent review offices- and officers in major centres, * which will handle disputes on rent ncreases, and ' a rent review ooard will hear appeals by :enants and landlords, against the decisions of rent review officers. In mid-December,' Ontario Hydro announced a 22 percent increase in wholesale .poviYer. rates to its 353 municipal and 102 direct , industrial customers, effective January E Hydro Chairman Robert B. Taylor said Hydro was 'following the recoinmendations of • the • Legislature's • Select Committee `and' the provincial government, for 1976 rates. The new wholesale rates are expected • to increase the monthly bill: of .a typical residential customer of a• municipal utility by. approximately 13.9 per Cent. Over a 12-month period. legislation. In the case of a written agreement, the important date is that on which such an agreement comes into effect, rather than the date on which the document is' signed,. . The rent review legislation is tied to the dwelling on an annual basis with the July 1975 rent taken as the baser t. A tenancy 'agreeement entered into or renewed and becoming effective between July 30th and December 31st, 1975, must reflect a maximum rent increase not exceeding eight per cent of the rent charged during the last full month prior to August 1St, 1975, unless tenant and landlord have agreed on a higher rate or the landlord has obtained the necessary approval from a rent review officer. If a landlord applies to a rent review officer for permission to increase rent by more than 8%, a tenant-mayfile application with the landlord requiring justification of the increase. These applications must be made by January 31st, 1976. If the, proposed excessive increase is, mutually agreeable to tenant and. landlord, then the rental increase agreeement must be signed no later than the 17th January, both parties retaining copies, Tenants • have an additional • 30 days a fter signature of such an agreement in which to •. reconsider • and file application with the rent review office. The agreement is only effective for the 31st payment period.ending 31st December , 1975. Either landlord or tenant can dispute the increase by filing an•application oa giving notice no later than Japuary 31st, 1976. If they do not agree op a rent increase above the 8% guideli ne, or db not apply tirha.ve the rent for that period reviewed, the tenant is entitled to a rebate of any rent paid in excess of 8% by February 16th, 1976, and if the landlord fails to make this rebate, the tenant may apply to a rent review officer for an order requiring payment.
